Sec. 8335) The Board of Supervisors of Contra Costa County RESOLVES THAT: This proceeding is to vacate approximately 4,289 square feet of surplus Reliez Valley Road right of way in the unincorporated area of Pleasant Hill . The vacation of the County's interest in the surplus right of way is made pursuant to the Streets and Highways Code Section 8334(a) and is based on the fact that the legislative body of a local agency may summarily vacate an excess right of way of a street or highway not required for street or highway purposes . For a description of the portion to be vacated, see Exhibit "A" attached hereto and incorporated herein by this reference. This Board hereby FINDS that the proposed vacation will not have a significant effect on the environment, and that it has been determined to be Categorically Exempt under State guidelines Section 15312 in compliance with the California Environmental Quality Act. The project does not have significant values for wildlife habitat or other environmental purposes and the property is of such size and shape that it is incapable of independent development or use. ' This Board FINDS that the subject property has been superseded by relocation and that the proposed vacation is part of a sale of surplus government property not located in an area of Statewide, regional or areawide concern. The Planning Department having filed its General Plan Report concerning this proposed vacation and this Board having considered the General Plan, it finds pursuant to Government Code Sec. 65402(a) that it has received the Planning Commission's report and in accordance with its Resolution No. 81/522 this vacation is of a minor nature and Government Code Section 65402(a) shall not apply to acquisitions, dispositions or vacations in connection with street or highway widening or alignment projects. This Board declares that the hereinabove described proposed vacation area is HEREBY ORDERED VACATED subject to any reservation and exception described in Exhibit "A". From and after the date this Resolution is recorded, the portion vacated no longer constitutes a highway. This vacation is made under the Streets and Highways Code, Chapter 4, Sections 8330 et seq. The legislative body of a local agency may summarily vacate a street or highway that has been superseded by relocation. Reserving therefrom, pursuant to the provisions of Section 8340 of the Streets and Highways Code, the easement and rights for the existing utilities conveyed to Contra Costa County by Deed recorded April 3, 1918, in Book 314 of Deeds, page 436, and any easement for water course over that portion of premises lying within the lines of Grayson Creek and any changes in the boundary lines of premises that have occurred or may hereafter occur from natural causes and by imperceptable degrees.
