HomeMy WebLinkAboutMINUTES - 10021984 - 2.9 q TO: BOARD OF SUPERVISORS Contra FROM: Phil Batchelor, County Administrator Co^s't�a} DATE: September 28 , 1984 County SUBJECT: Clayton Rehabilitation Center Fencing SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION Make findings that an emergency situation exists at the Clayton Rehabili- tation Center and installation and replacementof perimeter fencing is necessary to reduce the danger to life or property in the community; direct the Public Works Director to proceed with the project in the most expeditious manner pursuant to Section 20134 of the Public Contract Code and enter into any necessary contracts and declare that as an emergency, the project is not subject to the provision of the California Environ- mental Quality Act. BACKGROUND The Sheriff-Coroner has recommended that to reduce the danger to life and property in the community adjacent to the Rehabilitation Center that the funded project to replace the perimeter fence with a security fence be authorized to proceed on an emergency basis . Overcrowding at the Martinez Detention facility has caused an increase in average population at the Clayton Center from 90 to 190 comprised of approximately 90 Dercent felons without a commensurate increase in security measures; this has increased the danger to the community from potential walk-aways. In addition, the limited security provisions increase the incidence of smuggling drugs, alcohol and other contraband into the Center with resultant hazards for staff and inmates. The normal design, bid, construction process for installation of the fencing project is estimated to require five to six months. The Sheriff- Coroner considers such delay unacceptable to both the department and the community. It is possible to bypass the normal procedures for bidding the project and accomplish the project by the middle of November through the provisions of Section 20134 of the Public Contract Code when the appropriate findings of an emergency are made by the Board. It is recommended that the Board make such findings; direct Public Works to proceed with the project; and enter into any necessary contracts; and declare that, as an emergency, the project is not subject to the provisions of the California Environmental Quality Act (Public Resources Code 21080) .
