SUBJECT: Household Hazardous Waste Awareness Day
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) e: BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
That the Board:
1 . Approve in concept a Household Hazardous Waste Awareness Day subject to further
investigation and recommendations by the County Administrator and County Counsel .
2. Authorize appropriate County staff to participate with the Hazardous Waste Task
Force in planning for a Household Hazardous Waste Awareness Day to be held on
or about April 13, 1985 under circumstances more particularly set forth in the
request of the Hazardous Waste Task Force to the Board of Supervisors dated
September 12, 1984.
3. Authorize the Chairman of the Board of Supervisors to send a letter to Dwight Hoenig,
Chief, North Coast Section, Toxic Substances Control Division, State Department of
Health Services, requesting that the State Department of Health Services assume
generator responsibility for the hazardous wastes disposed of through the proposed
Public Awareness Day project.
4. Direct the County Administrator to send a letter to the Contra Costa Community
Recycling Center requesting permission to use the Center as a collection site
on the Public Awareness Day.
5. Direct the County Administrator to send a letter to Bay Area Environmental confirm-
ing use of their facility as a collection site on the Public Awareness Day and
asking for a detailed cost estimate of the services they could perform on Public
Awareness Day,.
6. Direct the County Administrator to obtain information from other public juris-
dictions that have sponsored a similar Public Awareness Day on how issues of
,liability were handled and what types of written agreements were entered into
with collection sites and firms that identified, packaged, and disposed of the
hazardous wastes that were collected. The County Administrator is to share this
information with County Counsel and they are jointly to recommend to the Board
of Supervisors whatever documents are deemed essential in order to clarify the
respective responsibilities of various agencies for elements of the Public
Awareness Day which could result in liability for the County, the Board of
Supervisors, and the County's officers and employees. Depending on the nature of
this report, the Board of Supervisors will then consider formally sponsoring
the Public Awareness Day. This report should be made by December 1 , 1984, if
at all possible.

As recommended by Supervisor Nancy Fanden, IT IS BY THE BOARD ORDERED that the Public
Works Director is REQUESTED to issue a press release informing the public of the location
of disposal sites for used automobile oil.

BACKGROUND:
On September 18, 1984, the County Administrator transmitted to the Board of
Supervisors the report and recommendations of the Hazardous Waste Task Force
requesting that the Board of Supervisors sponsor a Household Hazardous Waste
Public Awareness Day and take related actions. The Board referred this request
to the County Administrator and County Counsel for a report back to the Board
October 2, 1984.
Staff from the County Administrator' s Office and County Counsel ' s office have met
and reviewed this subject from the perspective of assessing the possibility
of liability exposure the County would face in sponsoring such an event. There
is a clear exposure to liability in case of an injury to any person or property.
There may be some ways to protect the County against such liability and to reduce
the risk of injury or damage. The County Administrator and County Counsel believe
these options should be explored, particularly with other public jurisdictions that
have sponsored such Public Awareness Days, such as the cities of Palo Alto,
Sacramento, and Oakland.
While this exploration is proceeding, we also believe that the other actions
recommended by the Hazardous Waste Task Force should proceed. We, therefore,
make the above recommendations and will work with the Hazardous Waste Task Force
to insure that the proposed Public Awareness Day is carefully planned and executed
in such a way as to heighten the awareness of the public to the potential dangers
of many common household products and how best to dispose of them or their residue.
