AYES: Supervisors Powers , Fanden, Schroder, McPeak, Torlakson

ASSENT: None
ABSTAIN: None
SUBJECT: Assessment District 1983-1
Pleasant Hill B.A.R.T. Station Protest Hearing
This being the time fixed for protest hearing on the
Engineer's Report for proposed improvements and assessments for
Assessment District 1983-1 - Pleasant- Hill R.A.R.T. Station area;
and
Mr. Richard Nystrom, Engineer of Work, having submitted
a revised "Description of Work" for the aforesaid District, having
reviewed the purposes , boundaries and proposals for the aforesaid
Assessment District , having advised the Board of the protests that
had been filed, and having filed four consents of property owners
to increase of assessment and one request of property owner to be
included in the Assessment District; and
The following persons having appeared and commented :
1 . Mr. Julius Duebner, who generally favored
formation of the District, but requested the
Board to delay action;
Z. Mr. Ed Dimmick , representing the Walden Associa-
tion, who favored formation of the District but
urged the Board to delay action; and
3. Mr. Sanford M. Skaggs , attorney for TTrban West,
who supported formation of the District with
the understanding that participation in the
District satisfies conditions of apgrroval for
his client 's project, specifically including
the condition that Urban West acquire a portion
of the Southern Pacific Right-of-Way, and urged
that the formation procedures be approved as
expeditiously as possible.
Supervisor Powers having suggested that the Public Works
staff meet with the various property owners to review the details
of the proposed district; and
Mr. Scott Clinton, representing Stone and Youngberg ,
who had submitted an offer to purchase bonds , having advised that
it would be necessary for his .company to submit another bid if
the proposal were not accepted this date, but that he was of the
opinion that there would probably not he a radical change of rates
either upward or downward; and
Supervisor McPeak having commented that in the interest
of giving land-owners (who have just learned of the Board 's action
with respect to realignment of Oak Road) the opportunity to join
this Assessment District, she would recommend continuing this
hearing to February 7, 1984 , with the ,understandi.ng that the Board
declare its intent to approve formation of the Assessment District
as it has been presented, provided no new information is submitted
in testimony; and
Supervisor Schroder having indicated his agreement , but
having urged that it' be emphasized that action will be taken on
February 7, 1984, and the Board will not further eontinue the
matter: �$�

IT IS BY THE BOARD ORDERED that this hearing is continued
to February 7, 1984 at 10: 30 A.M. ; .
IT IS FURTHER ORDERED that the revised "Description of
Work" filed by the Engineer of Work, a copy of which is attached
hereto and by reference incorporated herein, is hereby APPROVED.
IT IS FURTHER ORDERED that the Public Works Director
is requested to schedule a meeting with all interested parties to
fully discuss with the land-owners the implications and advantages
of joining this voluntary Assessment District and to answer any
questions the said land-owners might have.

EXHIBIT "A"
"Description of Work"
The construction or acquisition of street, storm drainage,
sanitary sewer, water, and utility improvements in Treat
Blvd. from Interstate 680 to the Walnut Creek Channel; in
Oak Road from Jones Road to Treat Blvd; in Oak Road exten-
sion from Treat Blvd. to Coggins Road; in Wayne Court and
its westerly extension from Oak Road extension to Buskirk
Road; in Las Juntas Road from Oak Road extension to the
Southern Pacific Railroad; Buskirk Road from Treat Blvd. to
Oak Road extension; in the off-ramp of Interstate 680; in
the new Jones Road entrance to the B.A.R.T. Station from the
B.A.R.T. Station to Treat Blvd. at the Southern Pacific Rail-
road; in the extension of Jones Road from Oak Road to Treat
Blvd. ; in the proposed bus lanes in the B.A.R.T. Station,
through the Southern Pacific Railroad right-of-way, to
Coggins Lane, and within easements to be designated.
The improvements shall consist of the following: clearing,
grading, paving, curbs and gutters, sidewalks, trail
systems, pedestrian overcrossing, street monuments, street
lights, street name signs, traffic control signs, striping,
traffic signals, storm drainage facilities, sanitary sewers
and appurtenances, water distribution facilities, fire
hydrants, and appurtenances, landscaping, the conversion of
electrical and communication facilities from overhead to
underground locations, utility conduits, gas mains, the
relocation of existing utility facilities, the acquisition
of capacity in existing storm drainage, sewage disposal, and
water facilities, together with the acquisition of all
necessary interests in real property.
