HomeMy WebLinkAboutMINUTES - 01311984 - 1.3 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on January 31, 1984 , by the following vote: AYES: Supervisors Powers , Fanden, Schroder, Mc Peak, Torlakson NOES: None ABSENT: None ABSTAIN: None SUBJEK pproval of the Parcel Map ) RESOLUTION NO. 84/64 _ and Subdivision Agreement ) for Subdivision MS 110-80, ) Walnut Creek Area. ) The following documents were presented for Board approval this date: The Parcel Map of Subdivision MS 110-80, property located in the Walnut Creek area, said map having been certified by the proper officials; ' A Subdivision Agreement with Clifford B. and Peggy J. T�jler, 'subdivider, whereby said subdivider agrees to complete all improvements as required in said- Subdivision Agreement within one year from the date of said agreement; Said documents were accompanied by security to guarantee the completion of road and drainage improvements as required by Title 9 of the County Ordinance Code, as follows: A. Cash deposit (Auditor's Deposit Permit No. 74881, dated January 31, 1984) in the amount of $1,000 made by William Claratr- B. Additional security in the form of a corporate ,,surety bdnd dated January 27, 1984, and issued by Amwest Surety Insurance (Bond No. 1042522 ) with Clifford B. and Peggy J. Teller as principal, in the amount of $18,000 for faithful performance and $9,500 for labor and materials. Said documents were also accompanied by a letter from the County Tax Collector stating that there are no unpaid County taxes heretofore levied on the property included in said map and that the 1983-84 tax lien has been paid in full. NOW THEREFORE BE IT RESOLVED that said subdivision, together with the provisions for. its design and improvement, is DETERMINED to be consistent with the County's general, and specific plans; BE IT FURTHER RESOLVED that said Parcel Map is APPROVED and this Board does not accept or reject on behalf of the public any of the streets, paths, or easements shown thereon as dedicated to public use. BE IT FURTHER RESOLVED that said Subdivision Agreement is also APPROVED. Assessor's Parcel No. 140-170-002 The Public Works Director has recommended that he be authorized to executei, a Deferred Improvement Agreement with Clifford B. and Peggy J. Teller, as required by the Conditions of Approval for Subdivision MS 110-80. This agreement would permit the deferment of construction of permanent improvements along Brodia Way which is located off La Casa Via in the Walnut Creek area. Assessor's Parcel No. 140-170-002 The Public Works Director has recommended that he be authorized to execute a Deferred Drainage Fee Agreement with Clifford B. and Peggy J.Teller, as required by the Conditions of Approval for Subdivision MS 110-80. This agreement would permit the deferment of the payment of drainage fees until such time as a drainage fee ordinance is adopted by the Board. IT IS BY THE BOARD ORDERED that the recommendation of the Public Works Director is APPROVED.
