G. WINGETT /�L�i Subject: STATUS REPORT ON BUDGET UNIT 0248 County Administrator AND CONTRACT NEGOTIATIONS WITH THE BAR ASSOCIATION On your January 31, 1984 agenda, item 1.26 represents an appropriation adjustment of $480,000 to provide for court appointed counsel in indigent cases pursuant to Penal Code Section 987.2. As you know, in the 1983/84 Final Budget, $900,000 was budgeted for this purpose. Final expenditures for fiscal year 1982/83 were $1,328,089. Based upon July through December 1983 data, it is estimated that expenditures for fiscal year 1983/84 will be $1,380,000, which is approximately $50,000 more than last year. Our reports to you have indicated that this budget unit would likely require about an additional $500,000 this fiscal year; this adjustment makes provision for this requirement. This Office (assisted by the Public Defender's Office and County Counsel) has made progress in negotiating a contract with the Bar Association for conflict defense services. The objective has been an improved, and less costly, system of providing court appointed counsel services. Through a series of meetings with Bar Association representatives, consensus has been reached on many of the County's specifications, which the Bar had failed to address in its previous proposals. Some of the items, such as utilization of attorneys and investigators have efficiency and cost-saving implications. The major unresolved items at this time are payment limit and attorney fee schedule. We are hopeful that agreement can be reached in the next four to six weeks. Staff is currently drafting a revised proposed contract between the County and the Bar Association. This will serve as a basis for what we hope will be our final negotiations with the Bar, leading to approval of a contract. The Bar anticipates a gearing-up phase of approximately three months before any contract can be operational. This time is needed to (1) hire a project director, and (2) to develop a panel of participating attorneys necessary for operation of the contract. A consideration is that each attorney participating in the program must sign an agreement with the Bar which incorporates the conditions in the contract and rules and regulations pertaining to such participation, including the fee schedule. The overall timetable is such then that relatively little impact of the revised system will be felt in the current fiscal year. If such final negotiations do not prove fruitful, we intend to recommend to your Board that this Office be authorized to proceed with establishment of a County Office of Alternate Defense to handle conflict cases.
