HomeMy WebLinkAboutMINUTES - 01241984 - 2.3 -� .3 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on January 24 , 1984 , by the following vote: AYES: Supervisor Powers , Fanden, Schroder, McPeak, Torlakson NOES: None ABSENT: None ABSTAIN: None SUBJECT: Health .and Safety Code ) Sectiori 1442.5 Hearing ) RESOLUTION NO. 84/48 of January 17, 1984: ) Additional Findings ) Pursuant to Health and Safety Code Section 1442.5, the Board conducted a public hearing on January 17, 1984 on proposed changes to programs in the County's Health Services Department; and adopted hearing findings on staff reductions (Resolution 84/30) . This Resolution expresses the Board's additional findings on remaining issues . I. The Board received written and oral evidence, as follows: A. Written documents were received into the record, and are filed with the Clerk of the Board of Supervisors, as follows: 1 . Board Order dated August 2, 1983 on policy assumptions relating to the future of the County Hospital . 2. RFI dated September 6, 1983 regarding surplus hospital beds. 3. Letter dated October 18, 1983 to Board of Supervisors re disposition of licensed beds. 4. Board Order dated October 25, 1983 regarding disposi- tion of licensed hospital beds. 5. Letter dated October 31 , 1983 to H. Dean Madison describing County's position on disposition of beds. 6. Board order dated November 15, 1983 and letter to Board dated November 14, 1983 on financial condition of Health Services Department . 7. Board Order dated November 29, 1983 referring to County Administrator memo dated November 17, 1983 from Ad Hoc Committee regarding proposal to hire a hospital management firm. 8. December 7, 1983 letter to hospital management firms transmitting Request for Proposals. 9. Board Order dated December 13, 1983 fixing January 17, 1984 for the hearing and attaching notice of public hearing. RESOLUTION 84/ 48 32.E A. P 10. Letter dated December 21 , 1983 to Dr. Peter Abbott transmitting copy of notice' of public hearing. 11 . ` Letter dated January 10, 1984 from Arnold Sterne Leff, M.D. regarding disposition of hospital beds. 12. Memo from Dr. Walker dated January 11 , 1984 providing background information on proposed reductions. 13. Memo of January 12, 1984, from C. L. Van Marter to members of the Board of Supervisors transmitting sum- mary of responses to RFP. 14. Such other documents as may appear in the records of the Clerk of the Board of Supervisors. B. Oral testimony was received, a summary of which will be filed with the Clerk of the Board of Supervisors. II. On the basis of the foregoing evidence, the Board makes the following findings: A. Notices of Public Hearing were posted on or before December 17, 1983 and such posting complied with Health and Safety Code §1442.5. B. "Indigents" are those persons defined in Resolution 84/24. C. Pursuant to Health and Safety Code §1442.5, all interested persons were allowed to speak and/or provide written comments at the hearing on January 17, 1984. D. The program reductions or changes considered at the January 17, 1984 public hearing were those contained in the notice approved by the December 13, 1983 order of this Board. E. The County faces a financial crisis which must be promptly addressed or it will become more acute. F. Findings on staff reductions are contained in Resolution 84/30, adopted after the close of the Hearing on January 17, 1984. G. The County Administrator's recommendation under the Notice of Public Hearing, "Additional Actions", Item 1 , was to delicense 106 'acute hospital beds (74 general acute beds and 32 acute psychiatric beds) ; The County would retain 208 licensed beds. Delicensing 106 beds will not have a detrimental impact on the health care needs of the County's indigents. H. The County Administrator and Acting Health Services Director recommendation under the Notice of Public Hearing, "Additional Actions", Item 2 is to contract with a Health Care Management firm for Hospital RESOLUTION NO. 84/ 48 322 f Management and finance expertise. The Board intends to retain policy control over the Health Services Department and all its operations and is therefore not contemplating the "transfer of management" of any "County health facility. Nevertheless, considering the current financial crisis, even actual transfer of management of the County's Hospital and Clinics would not be detrimental to indigents. There will be no detrimental impact from the award of a management and financial services contract. I . The Notice of Public Hearing "Additional Actions" , Item 3 proposed the removal of the former Medi-Cal "Medically Indigent Adults" (MIA's) from the Health Plan. Services would remain available at , and be provided by, County Health Services Staff at County facilities. There would be no detrimental impact on the health care needs of the County's indigents. III . If any finding as to an Item herein is held invalid, such invalidity shall not affect findings as to other Items which can be given effect without the invalid provision, and to this end , the invalid finding as to an item is severable. IT IS BY THE BOARD ORDERED that neither inclusion of a pro- posed change in a program in the Notice of Hearing, the holding of a hearing with respect to a change in a program included in the Notice of Hearing, nor the making of a finding as to such a change is to be construed as an admission by the County of Contra Costa or the Board that any of the program changes covered by the Notice are subject to the hearing provisions of Health and Safety Code 1442.5. IT IS FURTHER ORDERED that this resolution be included as a part of the official public hearing record and that the County Administrator and Acting Health Services Director are DIRECTED to implement the noticed changes, as directed by the Board. ccs State Dept.
