SUBJECT: Hearing on Proposed Reductions in the Health Services
Department (Beilenson Hearing)
This being the time for hearing pursuant to Health and
Safety Code Sections 1442 and 1442. 5 and the notice of public
hearing issued December 13, 1983; and
M. G. Wingett, County Administrator, having commented on
the actions taken to reduce the budget deficit, having reaffirmed
staff' s goal to bring the budget into balance by the end of this
fiscal year , and having advised that the reductions achieved to date
total approximately $1. 5 million; and
William Walker , M.D. , Acting Health Services Director,
having referred to his memorandum dated January 11, 1984 providing
background information relative to the staff reductions proposed,
having recommended a modification to the list of staff reductions
providing for the elimination of four rather than five Social
Workers (as noticed) and the elimination of 1. 5 Institutional
Service Workers rather than 2 Institutional Service Workers (as
noticed) ; and
C. L. Van Marter , Assistant County Administrator-Human
Services, having concurred with Dr. Walker ' s recommendations with
respect to proposed staff reductions, having commented on the
County' s plan to delicense certain of the County Hospital' s licensed
bed capacity, having commented on the number of beds the County
should be prepared to transfer to providers who have been granted
Certificates of Need, and having noted that six firms have responded
to the County' s Request for Proposals regarding the hospital manage-
ment contract and that staff is currently reviewing same; and
Mr. Van Marter having recommended that the Board take the
following actions:
1) Adopt Resolution No. 84-24 defining indigents;
2) Approve the amendment to the posted notice regarding
staff reductions consistent with the recommendations
of Dr. Walker as noted in his January 11, 1984 memo-
randum;
3) Include in the Hearing record the documents listed on
Attachment A (copy of which attached hereto and by
reference incorporated herein) ; and
The Board members being in agreement, IT IS ORDERED that
the recommendations of Mr. Van Marter are APPROVED.

Thereupon the Chairman having opened the hearing, and the
following persons having presented testimony:
Deborah Tupper , Medical Social Worker , expressed her
disapproval of the elimination of the Medical Social
Worker positions.
Henry L. Clarke, General Manager, Contra Costa Employees
Association Local 1, expressed his satisfaction with the
staff reassignments. He indicated that an attempt is
being made to upgrade the Hospital Attendants working on
the Mental Health wards. Mr. Clarke advised that he was
not supportive of the proposal to hire a management firm
to operate the Health Services Department because of the
expense involved but would be supportive of the employment
of a fiscal expert to provide the needed assistance, par-
ticularly in the area of Medi-Cal services.
John Baier, M.D. , requested the Board to review the costs
of operating the Contra Costa Health Plan to determine if
it is economically feasible to continue it. He referred
to the period when the Medical Services Department was
separate from the Public Health Department and noted
that the placement of two departments under a health
services director has not demonstrated any fiscal
advantages.
All persons desiring to speak having been heard IT IS BY
THE BOARD ORDERED that the public hearing is closed.
Passed by unanimous vote of the Board.
The Chairman having requested the inclusion in the hearing
record a letter dated January 10, 1984 from A. S. Leff, M.D. , former
Health Services Director , on the delicensure of the County' s hospi-
tal beds; and
Mr. Wingett having recommended that the Board adopt the
findings relative to staff reductions but to defer to January 24,
1984 findings relating to the delicensure of the hospital beds, a
proposed contract with a hospital management firm and the proposal
to remove the medically indigent adults from the Contra Costa Health
Plan; and
There being no further discussion IT IS BY THE BOARD ORDERED
that Resolution No. 84/30 adopting findings (pertaining to staff
reductions) and Resolution No. 84/31 (abolishing positions and
laying off employees) are hereby ADOPTED.

The Contra Costa County Board of Supervisors RESOLVES THAT:
The Contra Costa County Board of Supervisors hereby ADOPTS the
standards of aid and care for the indigent and dependent poor of the County as
established by Resolution No. 79/446 and amended by Resolution No. 80/1120 and
as amended by Resolution 83/1008, and the State established eligibility criteria
for individuals formerly eligible to the State's Medi-Cal Medically Indigent
Adult program, as more fully set forth in Resolutions 82/1486 and 83/191 , as the
general criteria for determining indigency for purposes of Health and Safety
Code Sections 1442 and 1442. 5. "Indigents" for purposes of the Board's January
17, 1984 legislative hearings pursuant to Health and Safety Code Section 1442. 5
are those persons eligible for County aid (General Assistance) and/or those
persons eligible for the Basic Adult Care (BAC) Program under Resolutions cited
herein.

Reductions )
Pursuant to Health and Safety Code Section 1442.5, the Board
conducted a public hearing on January 17, 1984 on proposed changes
to programs in the County's Health Services Department .
I . The Board received written and oral evidence, as follows:
A. Written documents were received into the record, and are
filed with the Clerk of the Board of Supervisors, as follows:
1 . Board Order dated August 2, 1983 on policy assumptions
relating to the future of the County'Hospital .
2. RFI dated September 6, 1983 regarding surplus hospital
beds .
3. Letter dated October 18, 1983 to Board of Supervisors

B. Oral testimony was received, a summary of which will be
filed with the Clerk of the Board of Supervisors .
II . On the basis of the foregoing evidence, the Board makes the
following findings:
A. Notices of Public Hearing were posted on or before
December 17, 1983 and such posting complied with
Health and Safety Code §1442.5.
B. "Indigents" are those persons defined in Resolution
84/24 .
C. Pursuant to Health and Safety Code §1442.5, all
interested persons were allowed to speak and/or
provide written comments at the hearing on January
17, 1984.
D. The program reductions or changes considered at the
January 17, 1984 public hearing were those contained
in the notice approved by the December 13, 1983 order
of this Board.
E. The County faces a financial crisis which must be
promptly addressed or it will become more acute.
F . Items 1 , 4, and 5 under "Staff Reductions" affect
various social welfare, psychiatric, and food service
positions or functions which do not involve direct
health care services and which will have no
detrimental impact on the health care needs of the
County's indigents.
G. Items 2 and 3 under "Staff Reductions" reduce dieti-
cian and medical staff positions which provide direct
health care services to partients. However, the
impact of the reductions appears to be minimal . There
will be no detrimental impact on the health care needs
of the County's indigents from these changes .
III . If any finding as to an Item herein is held invalid , such
invalidity shall not affect findings as to other Items which
can be given effect without the invalid provision, and to
this end, the invalid finding as to an item is severable.

IT IS BY THE BOARD ORDERED that neither inclusion of a pro-
posed change in a program in the Notice of Hearing, the
holding of a hearing with respect to a change in a program
included in the Notice of Hearing, nor the making of a
finding as to such a change is to be construed- as an
admission by the County of Contra Costa or the Board that any
of the program changes covered by the Notice are subject to
the hearing provisions of Health and Safety Code 1442.5.
IT IS FURTHER ORDERED that this resolution be included as a
part of the official public hearing record and that the
Acting Health Services Director is DIRECTED to implement the
noticed changes , as directed, by the Board .

Laying-Off Employees ) RESOLUTION NO. 84/31
The Contra Costa County Board of Supervisors in all of its capacities as the
governing body of this County and of the Districts and Agencies of which it is
the governing body, RESOLVES THAT:
1. The Board has considered the financial impact of reductions in funding due
to reduced state and federal funding and reduced tax receipts and other
revenues, the impact of increased funding requirements, and the staffing
necessary for the efficiency of County government operations, and has con-
sidered the staff retention plans submitted by the Health Services
Department.
2. In order to keep expenditures within available funding or to keep staffing
at the level necessary for efficient operations, it is necessary to abolish
the positions and create other positions described in the lists attached
hereto, for reasons of economy, lack of funds, or because the necessity for
the positions(s) involved no longer exists, and to lay off employees accord-
ingly. Said lists are incorporated herein by reference, and said positions
are hereby abolished or added effective on the dates indicated thereon.
3. The Director of Personnel shall prepare lists showing the order of layoff
of affected employees.
4. The heads of the departments in which such positions are abolished shall
issue layoff or displacement notices, as the case may be, and give notice
to the af�ected employees of the Board's action.
5. The Employee Relations Officer shall give notice of this Resolution to all
recognized employee organizations.
6. To the extent that the subjects of this Resolution are within the scope of
representation under the Meyers-Milias-Brown Act (Government Code §§3500 et
seq.), this Board offers to meet with any recognzied employee organization
representing affected employees upon request concerning this Resolution.
7. Recognized employee organizations representing affected employees may submit
to the Employee Relations Officer written requests to meet and confer on
specific proposals with respect to this Resolution or any resulting layoffs.
This authorization and direction is given without prejudice to the Board's
right to reduce or terminate operations or services of the County and of
Districts governed by this Board and to eliminate classes of employees or
positions, as involving the merits, necessity, or organization of services
or activities of the County or of Districts governed by the Board, and not
within the scope of representation.
8. This action is taken without prejudice to pending consulting, meeting, and
meeting and conferring with employee organizations.
9. This Resolution is an emergency action. There is not sufficient time to give
notice, meet with employee organizations or others, and to properly arrange
the affairs of the County or the other agencies before taking this action.

During the hearing on proposed reductions in the Health
Services Department Board members commented on the proposed
delicensure of surplus beds at the County Hospital and the legal
issues related thereto.
IT IS BY THE BOARD ORDERED that County Counsel is
requested to review the County's legal position regarding the
delicensure of the surplus hospital. beds and submit a legal opinion
to the Board by January 24 , 1984 .

Supervisor McPeak, having recommended that the County Administrator and
Acting Health Services Director be directed to request appropriate State and
Federal agencies to review the County' s estimates of Medi-Cal and Medicare
revenue for 1983-84 for their accuracy and provide their comments to the Board
and that selected private or district hospitals in the County be asked to do
the same;
