IN THE MATTER OF:
Recommendation to Consider Reconsideration of Boards
Decision of November 29, 1983, Awarding a Contract for
Emergency Medical Dispatch Response for Zone 7 (Antioch)
to East Contra Costa Ambulance Co.
The Board on December 20, 1983, having requested County
Counsel and the Acting Health Services Director to determine, whether
there is a basis for reconsideration of the Board' s decision of
November 29, 1983, to award the contract for Zone 7 to East Contra
Costa Ambulance Company, to determine whether there were any proce-
dural violations involved in the review of the bids and in the recom-
mendation to award the contract to East Contra Costa Ambulance
Company, and to report to the Board on January 17, 1984; and
This being the time fixed for the Board to reconsider its
decision of November 29, 1983, and a report dated January 11, 1984,
having been presented by County Counsel advising that there are no
legal grounds compelling such reconsideration, and having recommended
the Board accept this report, adopt findings supporting its decision,
and deny the request for reconsideration; and
Supervisor Torlakson having urged the Board to reconsider
its decision as he felt that there were several points of information
that were not before the Board in its original discussions which, he
believed, would merit further discussion by the Board; and
Supervisor Fanden having concurred, and having moved that
the Board reconsider its decision of November 29, 1983, and the motion
seconded by Supervisor Torlakson; and
In response to questions of Supervisor McPeak, Arthur
Wallenta, Deputy County Counsel, having recommended that the Board deny
the request for reconsideration; and
The Board members having considered the matter , the vote on
the motion was as follows:
AYES: Supervisors Fanden, Torlakson
NOES: Supervisors Powers, Schroder, McPeak
The motion failed to carry.
Supervisor Powers having them moved to adopt the findings as
set forth in Resolution 84/27, the motion seconded by Supervisor
Schroder , the vote was as follows:
AYES: Supervisors Powers, Schroder, McPeak
NOES: Supervisors Fanden, Torlakson

On December 20, 1983 the Board of Supervisors considered a
request frcmiAntioch Ambulance Service , Inc. , (Antioch Ambulance
Company) , supported by the City of Antioch, that this Board recon-
sider its award of the Contract to East Contra Costa Ambulance
Services , Inc . for County dispatched emergency calls in Emergency
Response Areas 6, 7, and 8. On that date the Board referred the
request to County Counsel and the Health Services Department "to
determine whether there were any procedural violations involved in
the review of the bids and in the recommendation to award the
contract to East Contra Costa Ambulance Company and report to the
Board on January 17 , 1984. . . ."
The Board , having received and considered the County Counsel's
written report which concludes that there was no due process
violation and that there are no legal grounds compelling this
Board to reconsider its prior decision and recommends that the
Board adopt findings demonstrating the basis for its decision,
accepts the County Counsel's report and makes the following
findings regarding the November 29 , 1983 award of the ambulance
service contract for Emergency Response Areas 6 , 7, and 8.
1 . The Contra Costa County Ordinance Code requires the County
to:
rr . . .contract , on a competitive basis , for
provision of emergency ambulance service in each
emergency response area to persons contacting the
County for such service. Said contracts shall pro-
vide for one primary eontractor .per emergency
response area, with allowance for back-up service
by other emergency ambulance service providers as
deemed necessary by the permit officer. In
awarding these contracts (ambulance service
agreements) the County shall consider the com-
parative value of competing proposals , including
consideration of:
(a) the quality of service to be provided;
(b) the level of service to be provided;

(c) therates charged for services to be
provided; and
(d) the costs , if any, to the County.
. . ." (§48-16.005, part . )
2. The October 11 , 1983 memorandum and attachments, from
Dr. Leff to the County Administrator and the Board of Supervisors,
describe the Request for Proposal (RFP) process used in evaluating
the comparative value of the competing proposals for ambulance
service contracts for Emergency Response Areas . 6, 7, and 8.
3 . The use of an ad hoc committee was an appropriate means of
considering the comparative value of the competing proposals .
4 . The membership of the ad hoc committee included medical ,
emergency response , and community representatives .
5 . The forty five (45) page Request for Proposal contained
sufficient detail to fairly apprise the prospective contractors of
the criteria to be considered in evaluating the proposals .
6 . The Emergency Medical Services Office (EMS) provided staff
support to the Ad Hoc Committee , including preparation of the
"Criteria for Review" and other work sheets used by the Ad Hoc
Committee in considering the key criteria as described in the
Request for Proposal (RFP) .
7. The specification of the key criteria in the Request for
Proposal (RFP) , the use of the criteria and work sheets by the ad
hoc committee members (Dr. Leff's October 11 , 1983 memo) , coupled
with the expertise of the ad hoc committee members and the EMS
staff report to Dr. Leff, resulted in a fair and technically
qualified consideration of the comparative value of the competing
proposals .
8. The concurrence of Dr . Leff in the recommendations of this
ad hoc committee and those of EMS staff resulted in contract
recommendations being made to the Board which were appropriate
from a technical emergency medical care delivery standpoint .
9 . The recommendations were based on technical judgment and
expertise and were subject to challenge and debate on that basis .
10. Once Dr. Leff' s contract recommendations were made to the
Board on September 27, 1983 all interested persons were allowed to
speak and to indicate why they believed the recommendations should
be followed or ignored.
11 . The records of this Board's consideration of these matters
on September 27, 1983, October 25, 1983 and November 29, 1983
indicate that persons interested in the contracts did address the
Board publically on these issues .

12. As to the Contract for Emergency Response Areas 6 , 7, and
8 , representatives of Antioch Ambulance Service , Inc. , were pre-
sent and addressed the Board with the view that their contract
proposal was more meritorious than that of East Contra Costa
Ambulance Services , Inc. In addition, the members of this Board
each received written communications from Antioch Ambulance
Service on this subject . The specifics of Antioch Ambulance
Service+s, claims included issues on the rates charged to "the
public and the timetable for implementation of Paramedic level
services .
13. The delays in contract implementation for Emergency
Response Areas 6 , 7, and 8, from September 28, 1983 through
November 30, 1983, allowed sufficient time for input from all
interested persons .
14. On November 29 , 1983 the recommendation from Dr. Leff,
the County Health Services Director, continued to be that made by
the Ad Hoc Committee and the EMS office--to award the contract to
East Contra Costa Ambulance Service, Inc.
15. Based on the recommendations and the technical expertise
of the Ad Hoc Committee , the EMS office , and Dr. Leff, the Health
Services Director , the Board awarded the Contract to East Contra
Costa Ambulance Service, Inc.
