HomeMy WebLinkAboutMINUTES - 01171984 - T.4 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on January 17, 1984 by the following vote: AYES: Supervisors Powers, Fanden, Schroder, McPeak, Torlakson NOES: None ABSENT: None ABSTAIN: None SUBJECT: Hearing on appeal of Cunha and Associates (applicants) and Monte and Lucia Albers (owners) from Conditional Approval of the County Planning Commisssion' s Tentative Map of Subdivision 6355, Deer Valley Area. The Board having continued to this time the hearing on the apppeal of Cunha and Associates (applicants) , and Monte and Lucia Albers (owners) from conditional approval of the County Planning Commission' s Tentative Map of Subdivision 6355, Deer Valley Area; and The Board having also declared its intent on December 20, 1983, to reject road improvement recommendations made by the Public Works Department; and Supervisor Torlakson having recommended that staff explore the feasibility of a Benefit Assessment District or some other plan to collect funds for road improvements needed in the Deer Valley area and also having recommended that the conditions placed by Public Works be eliminated, along with removing the Deferred Improvement Agreement from the original subdivision; and The Board having discussed the matter , IT IS BY THE BOARD ORDERED that: 1. The appeal of Cunha and Associates (applicants) , and Monte and Lucia Albers (owners) from conditional approval by the County Planning Commission, Tentative Map of Subdivision 6355, Deer Valley area is granted subject to the revised conditions submitted by the Planning Department dated November 29, 1983, (Exhibit A attached hereto and by reference incorporated herein) . 2. The Public Works Director is requested to review the County Road policy to explore the feasibility of a Benefit Assessment District or some other plan other than using frontage for spreading costs to fund road improvements needed along Deer Valley Road and Briones Road in the East County area; and 3. At their request, the owner' s obligation to provide funds for road improvements under the existing Deferred Improvement Agreement for MS 120-79 recorded May 13, 1980, (Book 9850, Page 788) , is removed; and 3`9 9 4. The Public Works Director is reguested to review the consistency of how County policy has been applied in the Deer Valley/East County area, particularly with respect to its January 12, 1984 staff report, and is further requested to meet with the applicant and the Director of Planning to discuss same. The Tentative Subdivision Map received on September 20, 1983, is approved for six lots of approximately five acres each subject to the following conditions. 2. The applicant shall pay $1,200 Park Dedication Fee. 3. The applicant shall provide adequate water supply and sewage disposal capabilities on each lot as approved by the County Health Services Department prior to the approval of the Final Subdivision Map. 4. The applicant shall submit the private road names to the Riverview Fire Protection District for their review and approval prior to the approval of the Final Subdivision Map. 5. The applicant shall submit grading plans for review and approval by the Director of Planning prior to the issuance of grading permits by the Building Inspection Department. 6. The applicant shall submit a preliminary soils report, grading and foundation plans prepared by a soil's engineer to the Building Inspection Department for their review and approval prior to the issuance of each building permit. 7. If• archaeologic materials are uncovered during grading, trenching or other on-site excavation,. earth work within 30 yards of these materials shall be stopped until a professional archaeologist who is certified by the Society for California Archaeology (SCA) and/or the Society of Professional Archaeology (SOPA) has had an opportunity to evaluate the significance of the find and suggest appropriate mitigation measures, if they are deemed necessary. 8. Prior to the issuance of a building permit for any lot, the applicant or owner of such lot shall provide fencing, which will contain domestic animals, with all gates to be closable by a nearby rancher when necessary. 9. In accordance with Section 92-2.006 of the County Ordinance Code, this subdivision shalt conform to the provisions of the County Subdivision Ordinance (Title 9). Any exceptions therefrom must be specifically listed in this conditional approval. 10. The following exceptions to Title 9 are permitted for this subdivision: A. Chapter 96-10, "Underground Utilities". B. Section 914-4.402, "Discharge to Roadside Ditches", provided the applicant verifies the adequacy of the downstream ditch system or constructs necessary improvements to upgrade the system to adequately convey runoff from this property. 401'. Sub 6355 pg. 2 C. Section 96-14.002, "Improvements of County Streets" for the ultimate road improvements which would correspond to County Drawing AP 111. 11. Abutter's rights of access shall be granted to the County along Deer Valley Road, with the exception of two points of access for private roads, shall be relinquished. The relinquishment shall include the right of way returns of the affected subdivisions. 12. The applicant shall construct a 16 foot all-weather private roadway, within a 25 foot access easement, to private road standards to serve all the parcels in this proposed subdivision and grade the roadway to a 20 foot width. 13. The applicant shall provide adequate sight distance in accordance with Caltrans stopping sight distances for horizontal and vertical curves for a design speed of 45 mph from the private roads within the subdivision. 14. The applicant shall provide proof to the Public Works Department, Land Development Division, of the acquisition of all necessary rights of entry, permits and/or easements for the construction of off-site, temporary or permanent, road and drainage improve- ments. 15. The applicant shall provide road right of way dedication as is necessary to provide for an 84 foot right-of-way of Deer Valley Road. As an informational item the applicant is advised to consult with the Riverview Fire Protection District regarding their request that (a) fire retardant roofing for each building be provided and that (b) a sprinkler system in each dwelling be provided and installed in accordance with NFPA Standard No. 13 D, a standard for installation of sprinkler systems in one or two family dwellings and mobile homes.
