NOES: None. ABSENT: Su-pervisor Schroder. ABSTAIN: None. SUBJECT: Clarifying Seniority Provisions ) for Deep Classes -Local 1 ) RESOLUTION NO. 82/ 1262 Whereas the County has established a number of deep classes; and Whereas the County recognizes that certain seniority provisions may be unclear in their application to those deep classes; and Whereas the County's representatives have met and conferred with Contra Costa County Employees' Association, Local No. 1 which represents those deep classes which are not for management or unrepresented employees and have agreed with Local No. 1 on the clarification of certain seniority provisions; The Board of Supervisors hereby AMENDS the Memorandum of Understanding between Contra Costa County and the Contra Costa County Employees' Association, Local No. 1, Reso 'lution No. 81/1006 and 81/1324 effective July 1, 1981 through June 30, 1983, as follows: Section 11.5 SENIORITY. An employee's seniority within a class for layoff and displacement purposes shall be determined by adding the employee's length of service in the particular class in question to the employee's length of service in other classes at the same or higher salary levels as determined by the salary schedule in effect at the time of layoff. Employees reallocated or transferred without examination from one class to another class having a salary within five percent of the former class, as provided in Section 305.2, shall carry the seniority accrued in the former class into the new class. Employees reallocated to a new deep class upon its initiation or otherwise reallocated to a deep class because the duties of the position occupied are appropriately described in the deep class shall carry into the deep class the seniority accrued or carried forward in the former class and seniority accrued in other classes which have been included in the deep class. Service for layoff and displacement purposes includes only the employee's last continuous permanent County employment. Periods of separation may not be bridged to extend such service unless the separation is a result of layoff in which case bridging will be authorized if the employee is reemployed in a permanent position within the period of the employ ee 's layoff eligibility ,, Approved leaves of absence as provided for in these rules and regulations shall not constitute a period of separation. In the event of ties in seniority rights in the particular class in question, such ties shall be broken by length of last continuous permanent County employment. If there remain ties in seniority rights, such ties shall be brok en by counting total time in the department in perman ent employment. Any r emaining ties shall be brok en by random selection among the employees involved. In addition, the Board of Supervisors hereby AMENDS the below listed deep class resolutions as follows : 1. Public Health Nurs e Deep Class Resolution No. 80/463, Sect ion 18: Seniority. An employ ee 's seniority for layoff and displacement purposes in the "d ee p class" of Public Health Nurse shall be determined by adding (a) his/her length of service in other classes at the same or higher salary levels as determined by the salary schedule in effect at the time of layoff and by adding (b) his/her length of service in the classes of Public Hea lth Nurse RESOLUTION NO. 82/1262 and Senior Public Health Nurse to other service described in (a) above. Service for layoff and displacement purposes includes only the employees last continuous permanent County employment. Employees reallocated to this deep class upon its initiation or otherwise reallocated to this deep class because the duties of the position occupied are appropriately described in the deep class shall carry into the deep class the seniority accrued or carried forward in the former class and seniority accrued in other classes which have been included in the deep class. Other rules affecting seniority are contained in the Personnel Management Regulations. 2. Fam"i1y Support Collections Officer Deep Class Resolution No. 81/154 and 82/615, Section 22: An employee's seniority for layoff and displacement purposes in the ''deep class" of Family Support Collections Officer shall be determined by adding (a) his/her length of service in other classes at the same or higher salary levels as determined by the salary schedule in effect at the time of layoff and by adding (b) his/her length of service in the classes of Collection Services Assistant I, Collection Services Assistant II and Collection Services Officer to other service described in (a) above. Service for layoff and displacemeint purposes includes only the employee's last continuous permanent County employment. (a) For purposes of layoff and displacement, no incumbents who occupy lower level assignment positions shall be considered as meeting the position requirements for higher level assignment positions. (b) For purposes of layoff and displacement, incumbents in higher level positions shall be considered as meeting the position requirements for lower level assignment positions. (c) Notwithstanding (b) above, incumbents of higher level positions may not displace into positions requiring bilingual proficiency unless thay possess the required proficiency. (d) Employees reallocated to this deep class upon its initiation or otherwise reallocated to this deep class because the duties of the position occupied are appropriately described in the deep class shall carry into the deep class the seniority accrued or carried forward in the former class and seniority accrued in other classes which have been included in the deep class. Other rules affecting seniority are contained in the Personnel Management Regu lat ·i ans. 3. Mental Health Treatment Specialist Deep Class Resolution 81/672 and 82/615, Section 17D: D. Seniority for those employees reallocated to the deep class of Mental Health Treatment Specialist on the date of this resolution or otherwise, promoted, demoted or transferred to the deep class of Mental Health Treatment Specialist shall be governed by the appropriate provisions of the Personnel Management Regulations. ( 1) (2) (3) (4) For purposes of layoff and displacement, no incumbents who occupy lower level assignment positions shall be considered as meeting the position requirements for higher level assignment positions. For purposes of layoff and displacement, incumbents in higher level positions shall be considered as meeting the position requirements for lower l•~vel assignment positions. Notwithstanding (2) above, incumbents of higher level positions may not displace into positions requiring licenses such as: Clinical Social Worker, Psychologist, Marriage and Family Counsellor or into positions requiring specialized experience such as Childrens and Adolescent Services, Conservatorship, Development Disabilities, Criminal Justice, Geriatrics, other specialties identified within the deep class specification or positions requiring bilingual proficiency unless said incumbents have such experience or possess such licenses. Employees reallocated to this deep class upon its initiation or otherwi se reallocated to this deep class becaus e the duties of the position occupied are appropriately described in the deep class shall carry into the deep class the seniority accrued or carried forward in the former class and seniority accrued in other classes which have been included in the deep class. RESOLUTION NO. 82/1262 4. Institutional Services Worker Deep Class Resolution 82/1028, Section 18. Seniority: Seniority for employees reallocated to the deep class of Ins t itutional Services Worker on the date of this Resolution, or otherwise demoted or transferred to the deep class of Institutional Services Worker shall be governed by appropriate provisions of the County Personnel Management System Regulations. For purposes of layoff and displacE!ment, no incumbents who occupy lower level assignment positions shall be considered as meeting the position requirement for higher level assignment positions. For purposes of layoff and displacement, incumbents in higher level assign- men t positions will be considered as meeting the position requirements for lower level assignment positions except that no one may displace into a position which is restricted unless the special qualifications for the position are met by the person displacing to the lower level.
