HomeMy WebLinkAboutMINUTES - 01101984 - 1.27 ,2-7 THE BOARD OF SUPERVISORS CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on January 10, 1984, by at least a four-fifths vote as following: AYES: Supervisors Powers, Fanden, McPeak, Torlakson, Schroder NOES: None ABSENT: None RESOLUTION NO. 84 J_9_ (Government Code 25526.5) SUBJECT: APPROVE exchange of Flood Control and Water Conservation District Property for Private Property Needed for Lower Pine-Galindo Creek and Approve Payment for Landscape Damage. Project No. 7520-688694 Concord Area The Board of Supervisors, as the Governing Body of the Contra Costa County Flood Control and Water Conservation District RESOLVES THAT: A portion of the property described in the Easement, recorded September 24, 1969, in Book 5968 of Official Records at page 470, is no longer required for flood control or other public purposes, its value does not exceed ten thousand dollars; and said portion of property no longer needed for flood control or other public purpose is described in Exhibit A, attached hereto, and incorporated herein by this reference. .A portion of real property owned by Stella Danker, adjacent to the above described property, is required for the District Lower Pine-Galindo Creek project. The County Principal Real Property Agent reports that the value of the portion of the Stella Danker property needed for the Lower Pine-Galindo Creek project is $600.00 plus the value of the portion which is no longer required for use by the District. This Board hereby DETERMINES that the matters set forth above are true, and hereby APPROVES an exchange of said excess property plus a payment of an additional $600.00 for the acquisition of the property rights needed from Stella Danker. The trailer park's landscaping in the temporary construction easement area covering a duplex and ten mobile home spaces was damaged during project construction. Payment of $9,392.00 to reimburse the park for replacing the landscaping is hereby APPROVED. The Right of Way Contract with Stella Danker, dated December 28, 1983, is APPROVED and the Public Works Director is AUTHORIZED to sign said Contract which covers both the property exchange and the landscaping, on behalf of the District. The County Auditor-Controller is AUTHORIZED to issue a warrant in the amount of $9,992.00 payable to Pioneer Title Insurance Company, Escrow 92-297809, to be delivered to the Real Property Division for payment. The Chairman of this Board is AUTHORIZED to execute a Quitclaim Deed, on behalf of the District, conveying the real property described in Exhibit "A" attached hereto, to Stella Danker. The Grant Deed from Stella Danker, dated December 28, 1983 is hereby ACCEPTED and the Real Property Division is DIRECTED to have said document and a certified copy of this resolution recorded in the Office of the County Recorder, Contra Costa County. 1 herby ear"that this Is a trueendcorrecte opy of Ori g.
