In the Matter of Accepting and Giving) RESOLUTION OF ACCEPTANCE
Notice of Completion of Contract with) and NOTICE OF COMPLETION
Rite Painting, Inc. (C.C. 93086, 3893)
Project No. 7100-4753;0928-WH753B RESOLUTION NO. 84/8
The Board of Supervisors as the Governing Body of the Contra Costa County Fire Protection
District RESOLVES THAT:
The Contra Costa County Fire Protection District (hereinafter referred to as the District)
on October 5, 1982 contracted with Rite Painting, Inc., 2623 North Main Street, Walnut
Creek, CA 94596, for Repainting Administration Building, 2010 Geary Road, Pleasant
Hill , CA 94523, Authorization No. 7100-4753;0928-WH753B with Surety Insurance Company
of California as surety, for work to be performed on the grounds of the County; and
The Public Works Director reports that said work has been inspected and complies with
the approved plans, special provisions, and standard specifications, except that the
contractor has failed to submit to the District the written guarantee required by the
contract documents, and recommends said,work be accepted as complete as of January 10,
1984;
Therefore, said work is accepted as completed, excepting the certificate of guarantee
requirement, on said date, and the Clerk shall file with the County Recorder a copy
of this Resolution and Notice as a Notice of Completion for said contract; and
Time extension to the date of acceptance is granted since the sole reason for delay
of contract acceptance after the original contract time was because the necessary guarantee
was not submitted to the District; and
It is by the Board further affirmed that the contractor shall be held fully liable for
the guarantee provisions of the contract documents with or without receipt of the guarantee
certificate; and
The County Auditor-Controller is hereby directed not to authorize payment of the remaining
$670:00 retention otherwise due the contractor until the necessary certificate of guarantee
is received by the District.

AYES: Supervisors Powers, Fanden, McPeak, Torlakson, Schroder

ABSENT: None
