The following document was presented for Board approval this date:
A substitute Subdivision Agreement with MEM Investment Company, Inc.,
subdivider, whereby said subdivider agrees to complete all improvements as- required
in said Subdivision Agreement by August 18, 1984;
Security to guarantee the road and drainage improvements as required
by Title 9 of the County Ordinance Code is as follows:
a. Cash deposit (Auditor's Deposit Permit No. 43644, dated August 10,
1981) in the amount of $1,000, made by Sobrante Properties, Ltd. This cash
deposit has been assigned by Sobrante Properties, Ltd. to MEM Investment Company,
Inc.
b. Additional security in the form of a corporate surety bond, dated
August 5, 1981, and issued by Surety Insurance Company (Bond No. 551914) with
Sobrante Properties, Ltd. as principal , in the amount of $28,300 for faithful
performance and $14,650 for labor and materials. This bond was extended to
August 18, 1984 by the Board on October 11, 1983. A rider to this bond, dated
December .12, 1983, changes the named principal from Sobrante Properties, Ltd. to
MEM Investment Company, Inc.
NOW THEREFORE BE IT RESOLVED that said substitute Subdivision Agreement
is APPROVED.
BE IT FURTHER RESOLVED that the Subdivision Agreement with Sobrante
Properties, Ltd. as approved by the Board on August 18, 1981 , is TERMINATED
and the improvement security bond rider, dated December 12, 1983, issued by
Surety Insurance Company is ACCEPTED.
