The Board of Supervisors of Contra Costa County RESOLVES THAT:
This vacation is made pursuant to Streets and Highway Code
Section 8330.
For a description of the portion to be vacated, see Exhibit
"A" attached hereto and incorporated herein by this reference.
This Board hereby FINDS that the proposed vacation will not
have a significant effect on the environment, and that it has been determined
to be categorically exempt under State guidelines Section 15112(a)(1)
in compliance with the California Environmental Quality Act. The subject
parcel of land is of such size or shape that it is incapable of independent
development or use.
The Planning Department having made its General Plan report
concerning this proposed vacation and this Board having considered the
General Plan, it finds pursuant to Government Code Sec. 65402(a) that
in accordance with its Resolution No. 81/522 this vacation is of a minor
nature.
This Board declares that the hereinabove described proposed
vacation area is HEREBY ORDERED VACATED subject to any reservation described
in attached Exhibit "A" . From and after the date this Resolution is
recorded, the portion vacated no longer constitutes a highway. This
vacation is made under the Streets and Highways Code, Chapter 4, Section
8330 et seq.
This Board AUTHORIZES the Public Works Director to dispose
of said vacated area.
The Public Works Director shall file with the County Clerk
a Notice of Exemption concerning this vacation.
A certified copy of this resolution, attested by the Clerk
under seal, shall be recorded in the Office of the County Recorder.

EXHIBIT "A"
A portion of Lot 136, lying within the boundaries of Ayers Road, as said
lot and road are delineated on the map entitled "R.N. Burgess Company's Map
No. 1, Ayers Ranch Subdivision, Contra Costa County, California" recorded
July 2, 1912 in Book 7 of Maps at page 170, records of Contra Costa County,
State of California, further described as follows:
Commencing at the most westerly corner of the parcel of land described in
the quitclaim deed. to Contra Costa County recorded September 15, 1941 in
Book 622 of Official Records at page 184, said point also being the point
of intersection of the northeasterly line of Myrtle Drive and the northwesterly
line of, Ayers Road as shown on the Record of Survey Map filed March 8, 1977
in Book 62 of Licensed Surveyors Maps at page 8, records of said County;
thence north 610 04' 30" east 5.85 feet to the true point of beginning; thence
north 610 04' 30" east 103.76 feet along the northwesterly right of way line
of Ayers Road; thence leaving said right of way line south 290 44' 00" west
68.62 feet; thence westerly along a curve, concave to the north, having a
radius of 20.00 feet, through a central angle of 900 00' 00", an arc length
of 31 .42 feet; thence north 600 16' 00" west 33.97 feet to the true point
of beginning.
Containing an area of 2,305 square feet, more or less.
RESERVING THEREFROM, pursuant to the provisions of Section 8340 of the Streets
and Highways Code, the easement and right at any time, or from time to time,
to construct, maintain, operate, replace, remove and renew equipment and
fixtures for the operation of gas pipelines, and for incidental purposes,
including access to protect the property from all hazards in, upon and over
the area hereinbefore described to abandoned.
