Michael Walford, Public Works Director SUBJECT: 1982-83 Storm Damage Repairs - Status r During FY 1983-84 this department has completed, or will have completed, 35 storm damage repair projects. The cost of these projects, and related expenses, is estimated to be $1 ,085,000 of which we anticipate federal reimbursement (FEMA & FHWA) totaling $509,000. The balance of local cost is included in the advance allocation of $650,000 approved by the Board on August 2, 1983 for storm damage repair. A listing of these projects, with cost and funding data, is shown on Attachment A. After reviewing and reevaluating the remaining 1982-83 storm damage projects, we feel there are enough significant changes to warrant a revision of the priorities as approved by the Board on April 26, 1983. The four categories (Priority I - IV) have been replaced with a numerical listing which was obtained by the summation of a series of weighted values . The factors considered were public benefit (principal road usage) , road classifications, benefit/local cost ratio, severity and impact of damage, and the estimated percentage of federal assistance. The revised priority list, including the weights assigned to each factor and the cost data, is as shown on Attachment B. We recommend that the Board approve the revised priority list and the basis of its formulation. Funding for the remaining projects is still a problem. As indicated on Attachment B, the estimated local cost for the remaining repairs is $2,900,000. This estimate is based on the optimistic assumption that federal funding for the on-system (FAU, FAS) roads will be approved, the participation will remain close to 100% as in the past and the pessimistic opinion that FEMA will not change its position on the non-eligibility of slide stabilization work. However, despite the efforts of many, including the State of California, California's congressional delegation and the California Supervisors Associ- ation, legislation has not yet been approved which would remove the $30,000,000 limit on the program which funds the on-system repairs. According to Mr. Will Kempton, California Department of Transportation-Congressional Liaison, no action has been taken on H.R. 3103 since Congress has convened. Another campaign is being organized by C.S.A.C. to bring this matter to the attention of Congress. If the approval of this funding is delayed beyond July 1, 1984. it is probable that the major projects such as Ygnacio Valley Road, Marsh Creek Road, and Castro Ranch Road will be delayed until the following construction season. 270 We have included in our proposed budget for F.Y. 1984-85 a $500,000 general fund allocation to continue the repairs on the major storm damage items . Providing the Board approves this request and the revised priority list the top twelve projects with the exception of Carquinez Scenic Drive could be completed during F.Y. 1984-85. The recently enacted Mello Bill (S.B. 78) could be utilized as a source of local funds if the Board desires to either expedite repairs or spread the local cost over a longer period of time. In summary S.B. 78 provides the following: - Loans to public entities to assist with the local costs associated with the FEMA program or the Natural Disaster Assistance Act. - A 5-year repayment period. - An interest rate based on pooled money investment account rates (approx. 9%). - Funds can only be used for the specified projects. - Program has a cap of $15,000,000. If the approved applications exceed this amount, pro rata shares will be distributed. - Applications must be submitted no later than March 15, 1984. We have included as Attachment C a summary of the funds which could be applied for based on a selected payback schedule and the projects which could be funded in each case. It should be noted that this program does not apply to the on-system route damages. All local costs for these repairs will have to be provided for separately. It is estimated that these costs total $140,000. See projects with asterisk (*) in Attachment B. We recommend that the Mello Bill Loan Program be used only if the Board feels comfortable with allocating a specified sum of General Fund money, each year for the next five years, to repay the loan. Taking advantage of the program would reduce the costs associated with increased damage and rising construction costs. However, a "pay as you go" program also has advantages, i .e. no interest costs. It should be noted that the application for participation in the loan program must be postmarked no later than March 15, 1984. Consequently, the Board must decide by March 6, 1984 whether to participate or not.
