Adopted this Order on February 28, 1984 , by the following vote:
SUBJECT: DISPOSITION OF COUNTY HOSPITAL SURPLUS LICENSED BED CAPACITY
The County Administrator having submitted a report to the Board dated
February 27, 1984 making certain recommendations regarding the disposition of
106 of the County's presently surplus licensed bed capacity, and having summarized
the basis for his recommendations; and
Supervisor Schroder having asked what the dollar per bed was from each
provider; and
The County Administrator having responded that the dollar offers range from
$5000 per bed to approximately $17,000 per bed, and having summarized the addi-
tional consideration which was taken into account in regard to the offers from
Delta Memorial and Los Medanos hospitals; and
Supervisor Schroder having expressed his concern about the wide discrepancy
in the cash offers being made, and having expressed his belief that the County
should receive the maximum revenue possible; and
Supervisor Powers having expressed his view that the bed licenses have
considerable value and that, in his opinion, the current offers being made by the
providers are not satisfactory, and having recommended that the entire matter be
referred back to staff; and
Supervisors Torlakson and Fanden having agreed with Supervisor Powers that
the offers were unsatisfactory, and that staff should conduct further negotiations
and have a response back to the Board in one week; and
Supervisor McPeak having expressed her agreement with the general direction
of the Board's discussion, and having noted that she will abstain on any decision
to dispose of the County Hospital 's bed licenses because of.her involvement in
the Contra Costa Health Coalition and her belief that further construction of
hospital beds will cost more money which, in the long run, will drive up the cost
of health care, and having expressed her concern about the process followed by the
State in terminating the hearing process because there was not an opportunity for
full disclosure of all of the facts involved and because the State did not look at
the ramifications of their recommendations on the care of the poor and indigent in
the County; and
Supervisor Powers having suggested that further clarification is needed
from staff and that this matter should be discussed in Closed Session so that the
Board can distinguish between the beds which are involved in the current lawsuit
brought by the Health Systems Agency and John Muir Hospital from the beds which
are not involved in that lawsuit; and
Supervisor Powers having MOVED that the Board consider this issue in Closed
Session and that the entire matter be referred back to staff to pursue negotiations
further; and
Supervisor Fanden having seconded the motion, the motion was ADOPTED by
the following vote:
AYES: Powers, Fanden, Schroder, Torlakson
NOES: None
ABSTAIN: McPeak

The Board having reconvened from Closed Session, and Susan Brill-Lehn,
Executive Director, Alameda-Contra Costa Health Systems Agency, having addressed
the Board, and having noted that in the opinion of the Health Systems Agency
the currently granted Certificates of Need will create 161 more beds than are
required in the County by the year 1990, and that their information is that it
costs a hospital $40,000 a year to operate a bed, and having suggested to the
Board that if the outcome of the pending lawsuit shows that the currently
granted Certificates of Need are not valid, they may be changed as a result of
the hearing process and that that would change the conditions of the County's
agreement to delicense beds, and having recommended that the Board postpone
any decision to delicense beds until the lawsuit is resolved; and following a
brief recess, Supervisor Fanden having MOVED to direct the County Administrator
and Acting Health Services Director to negotiate a contract with National Medical
Enterprises providing for a total payment of $1 ,800,000; $2009000 of which would
be a non-refundable down payment, payable upon execution of a mutually acceptable
contract which would otherwise contain generally the conditions recommended by
the County Administrator in his letter of February 27, 1984; and
Supervisor Schroder having seconded the motion, the MOTION was APPROVED
by the following vote:
AYES: Powers, Fanden, Schroder, Torlakson
NOES: None
ABSTAIN: McPeak
Supervisor Powers having MOVED to refer to the County Administrator the
issue of other beds which may be surplus for a subsequent report to the Board of
Supervisors, and Supervisor Fanden having seconded the motion, the MOTION was
APPROVED unanimously.
