C. 4 APPROVE and AUTHORIZE the Public Works Director, or designee, to execute
a Right of Way Contract, with modified indemnification language, to pay AU
Energy, LLC, $14,500 to acquire a temporary construction easement over
property located at 2876 El Portal Drive, San Pablo, CA, for the I-80/San Pablo
Dam Road Interchange Project-Phase I, as recommended by the Public Works
Director. (100% Contra Costa Transportation Authority funds)
C. 5 ACCEPT the 2013 Semi-Annual report of real estate acquisition acceptances
dated July 1, 2013 to December 31, 2013 approved by the Public Works Director
for the acquisitions of any interest in real estate where the purchase price for the
real estate interest did not exceed $50,000, Antioch, Bay Point, Brentwood,
Martinez, and San Pablo areas. (No fiscal impact)
C. 6 APPROVE and AUTHORIZE the Public Works Director to execute a contract
with East Bay Regional Park District (EBRPD) in an amount not to exceed
$14,000 to assign and vacate a segment of excess road right of way to EBRPD for
the Feeder Trail No. 1 Project from Ferndale Road to Periera Road, effective
March 18, 2014 until completion of the project, Martinez area. (100% EBRPD
Funds)

C. 7 ADOPT Resolution No. 2014/118 approving the second extension of the
Subdivision Agreement for minor subdivision MS09-00011, for a project being
developed by NRG Energy, Inc., as recommended by the Public Works Director,
Antioch area. (No fiscal impact)
C. 8 ADOPT Resolution No. 2014/119 approving the seventh extension of the
Subdivision Agreement for subdivision SD89-07267, for a project being
developed by Morgan Capital Investment Properties/Lafayette – King Drive
Associates, LLC, as recommended by the Public Works Director, Lafayette area.

C. 9 ADOPT Resolution No. 2014/120 accepting completion of the warranty period
and release of cash deposit under the Road Improvement Agreement for
RA10-01246, for a project developed by Shapell Homes, a Division of Shapell
Industries, Inc., a Delaware Corporation, as recommended by the Public Works
Director, San Ramon (Dougherty Valley) area. (100% Developer Fees)

C. 10 APPROVE and AUTHORIZE the Director of Airports, or designee, to execute a
Consent to Leasehold Encumbrance and Estoppel between the County, as
Landlord, Byron Aviation Services Limited, as Tenant, and Scott Valley Bank, as
Tenant’s Lender, for leased premises, commonly known as 7500 Falcon Way, at
the Byron Airport. (No fiscal impact)
C. 11 APPROVE the Notice of Intention to Sell Property owned by Contra Costa
County Flood Control and Water Conservation District, identified as a 0.32-acre
portion of Assessor’s Parcel No. 187-130-012 located at 1420 Livorna Road,
Alamo, as recommended by the Chief Engineer. (100% Flood Control Zone 3B
Revenue Funds)
C. 12 APPROVE and AUTHORIZE the Director of Airports, or designee, to execute a
fourth lease amendment between the County, as lessor, and TDMC, LLC, as
tenant at the Buchanan Field Airport, to permit the tenant to operate the premises
as an executive hangar and relieve the tenant of requirements for construction of
additional improvements. (No additional fiscal impact)
C. 13 APPROVE and AUTHORIZE the Chief Engineer or designee, Flood Control and
Water Conservation District, to execute, on behalf of the Contra Costa Clean
Water Program, the Second Amendment to the Stormwater Utility Area
Agreement between the District and the City of San Pablo; and the Amendment to
the Amended and Restated Contra Costa Clean Water Program Inspection
Activities Agreement adding the City of San Pablo as a participating
municipality. (No fiscal impact)
C. 14 ADOPT the San Francisco Bay Area and East Contra Costa County Integrated
Regional Water Management Plans dated September 2013; AUTHORIZE the
Chief Engineer, Contra Costa County Flood Control and Water Conservation
District, or designee, to execute documents signifying the District’s adoption and
continued participation in the process of updating, modifying, and reviewing the
Plans as needed, as recommended by Transportation, Water and Infrastructure
Committee, Countywide. (100% Flood Control District Funds)
C. 15 APPROVE and AUTHORIZE the Airports Director, or designee, to apply for and
accept Airport Improvement Program (AIP) grants from both the Federal
Aviation Administration (FAA) and the California Department of
Transportation-Division of Aeronautics (Caltrans) for approximately $3,406,500
and $85,163, respectively, to perform environmental analysis, design,
engineering, and complete maintenance of Runway 14L/32R pavement at
Buchanan Field; and AUTHORIZE the Chair of the Board of Supervisors to
execute a Statement of Acceptance with the Federal Aviation Administration for
the grant funds; Pacheco area. (90% FAA, 2.25% Caltrans, and 7.75% Airport
Enterprise fund)
C. 16 APPROVE and AUTHORIZE the Airports Director, or designee, to apply for and

C. 16 APPROVE and AUTHORIZE the Airports Director, or designee, to apply for and
accept Airport Improvement Program (AIP) grants from both the Federal
Aviation Administration (FAA) and the California Department of
Transportation-Division of Aeronautics (Caltrans) for approximately $1,478,700
and $36,968, respectively, to perform environmental analysis, design,
engineering, for maintenance of various taxiway pavements and signage upgrades
at Buchanan Field; and APPROVE and AUTHORIZE the Chair of the Board of
Supervisors to execute a Statement of Acceptance with the Federal Aviation
Administration for grant funds; Pacheco Area. (90% FAA, 2.25% Caltrans,

C. 17 Acting as the Board of Directors of the Contra Costa County Fire Protection
District, APPROVE and AUTHORIZE the Fire Chief, or designee, to terminate
the Amended and Restated Fire Fighting Services Agreement between the Contra
Costa County Fire Protection District and the City of Pinole, as recommended by
the Fire Chief. (Cost savings)
C. 18 ADOPT Resolution No. 2014/128 honoring Battalion Chief Andrew Steffen on
the occasion of his retirement from the Contra Costa County Fire Protection
District, as recommended by the Fire Chief.

C. 19 APPROVE and AUTHORIZE the County’s participation in the settlement of In
re Dynamic Random Access Memory Antitrust Litigation, Northern District of
California Case No. M-02-1476-PJH, as recommended by the Chief Information
Officer. (Settlement payment to County)
C. 20 RECEIVE public report of litigation settlement agreements that became final
during the period of March 1, 2014 through March 31, 2014.
C. 21 DENY claims filed from Kenneth Bartlett, Imelda Fuller, East Bay Animal
Rescue & Refuge and Ray Gonzales, Menke Hu and Cheng Y. Yang. DENY
amended claim filed from AAA – NCNU for Paul Stickel; and DENY application

Board of Directors to a term expiring December 31, 2014, as recommended by

Commission for Women to a term expiring February 28, 2017, as recommended

C. 37 APPOINT Theresa Kula to the District V Public Sector seat on the Economic
Opportunity Council to a term expiring June 30, 2015, as recommended by

C. 38 RE-APPOINT Jerome E. Hatfield and Edgar H. Grubb to the Public No. 1 and 2

C. 39 RE-APPOINT Richard (Tom) Chapman to the At Large #2 seat on the Contra
Costa County Fire Protection District Advisory Fire Commission, as

C. 40 DECLARE vacant the Child Care Provider 3 - Central/South seat on the Contra
Costa Local Planning Council for Child Care and Development, as recommended
by the Council.
Appropriation Adjustments
C. 41 Emergency Services (0362): APPROVE Appropriations and Revenue Adjustment
No. 5060 authorizing new revenue in the amount of $220,000 in Sheriff's
Office-Emergency Services Division from 2012 California Homeland Security
grant funds and appropriating it for the purchase of a Ballistic Identification
System.
C. 42 Department of Support Services (0296): APPROVE Appropriation and Revenue
Adjustment No. 5061 and AUTHORIZE the expenditure appropriation transfer of
$57,962,000 from Employment and Human Services Dept. (0292) to Support
Services Dept. (0296) to reflect State Controller's requirements as recommended
by the Employment and Human Services Director. (No fiscal impact)

Intergovernmental Relations
C. 43 ADOPT a position of "Support" on AB 1799, as introduced (Gordon): Land use:
mitigation lands, a bill that would eliminate the requirement of an endowment for
long-term stewardship where a governmental entity is the entity required to
provide the long-term stewardship, if the governmental entity provides evidence
that it possesses an investment-grade credit rating, and provides either a
resolution adopted by the legislative body of the governmental entity or a
contractual agreement with the local or state agency enforcing the mitigation
requirements, as recommended by the Legislation Committee.
C. 44 ADOPT a position of "Support" on SB 1300, as introduced (Hancock):
Refineries: turnarounds, a bill that would require every petroleum refinery to
submit to the Division of Occupational Safety and Health, a full schedule of
planned turnarounds, meaning a planned, periodic shutdown of a refinery process
unit or plant to perform maintenance, overhaul, and repair operations and to
inspect, test, and replace process materials and equipment for the following
calendar year; provide any information provided that is a trade secret is
confidential; and authorize the charging of fees for actions regarding refineries, as
recommended by the Legislation Committee.
C. 45 ADOPT a position of "Oppose" on SB 979, as amended (Beall): Local public
employee organizations: differences, a bill that would provide that differences
under provisions of the Myers-Milias-Brown Act include those differences that
arise from any dispute over any matter within the scope of representation as to
which an obligation to meet and confer exists and are not limited to negotiations
after impasse after collective bargaining for a new or successor memorandum of
understanding, as recommended by the Legislation Committee.
C. 46 ADOPT a "watch" position on SB 837 (Steinberg): Transitional Kindergarten, a
bill that requires each school district or charter school that offers kindergarten to
offer transitional kindergarten, as recommended by the Legislation Committee.
C. 47 ADOPT an "Oppose" position on AB 2126, as amended (Bonta):
Meyers-Milias-Brown Act: mediation, a bill that would authorize either
bargaining party in the collective bargaining process to request mediation if they
fail to reach agreement, as recommended by the Legislation Committee.
C. 48 APPROVE Transportation, Water and Infrastructure Committee report and
recommendations on transportation-related legislation and school siting reform.
C. 49 ADOPT Resolution No. 2014/114 as approved by the Retirement Board, which
establishes the Central Contra Costa Sanitary District retirement plan
contribution rates effective July 1, 2014 through June 30, 2015, as recommended
by the County Administrator.

Health Worker II (represented) and its incumbent to Community Health Worker

C. 51 ADOPT Position Adjustment Resolution No. 21429 to cancel one part time
(20/40) Library Assistant-Journey Level (represented) position and increase the
hours of one part time Library Assistant-Journey Level (represented) position to

C. 52 ADOPT Position Adjustment Resolution No. 21430 to increase the hours of one
