THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on February 21, 1984 , by the following vote:
AYES: Supervisors Powers, Fanden, Schroder, McPeak, Torlakson
NOES: None
ABSENT: None
ABSTAIN: None
SUBJECT: Hearing on appeal of Maurice and Marlana Woulf from Board
of Appeals decision of application of Robin Lynn Goepfert
for Variance Application Number 1067-83 for sideyard and
rearyard variances, for a residence in the E1 Cerrito area.
This being the time fixed for hearing on the appeal of
Maurice and Marlana Woulf from Board of Appeals decision of applica-
tion of Robin Lynn Goepfert for Variance Application Number 1067-83
for sideyard and rearyard variances, for a residence in the El
Cerrito area; and
Harvey Bragdon, Assistant Director of Planning, having
described the property as being on the southerly side of Sequoia
Avenue, in the east Richmond Heights area, north of the City of E1
Cerrito; and
The Chairman having opened the public hearing; and
Michael Celestre, attorney, representing Robin Lynn
Goepfert, having appeared and having rendered an account of the
details of the aforesaid appeal and having urged the Board to uphold
the decision made by the Board of Appeals to grant the sideyard
variance; and
John Pierce, attorney, representing Maurice and Marlana
Woulf, Kenneth Osborne and Betty Graham, having appeared and
expressed opposition to the Board of Appeals approval of a variance
for a 2. 5-ft, sideyard for a two-story residence adddition, and also
having submitted to the Board a letter from, Jean T. Smith, Director
of Planning, City of El Cerrito, stating that the Geopfert' s pro-
perty is located in the sphere of influence of the City of E1
Cerrito, and expressing concern with the manner in which the
Geopferts are making additions to their property; and
Maurice Woulf, 1502 Palm Avenue, Richmond, CA, having
appeared and stated that in his opinion the applicants lot size and
shape provided ample room for building additions to be added without
requiring substandard rear and sideyard variances, and having urged
the Board to act in the best interest of the neighbors in the ar.ea
and deny the application for a sideyard variance; and
Betty Graham, 1496 Palm Avenue, Richmond, CA, having
appeared in opposition to the application for a sideyard variance; and
Michael Celestre, attorney representing Robin Lynn
Goepfert, having appeared in rebuttal and having urged the Board to
uphold the decision made by the Board of Appeals and approve the
sideyard variance; and
The Chairman having closed the public hearing; and

Supervisor Torlakson having commented on the complexity of
this issue and on the questions that had been raised by both parties
during the hearing, and commented on the need to get answers in terms
of the County' s participation in 'this issue; and
Supervisor Powers having commented on the .need to look
further at the issues surrounding the application, and also to give
the Goepferts some additional time to bring the existing additions on
their property into compliance at this time, as opposed to having
some document recorded which would require conformance later , and
having suggested that the Planning Staff look into the preparation
of a document or declaration indicating that the buildings on the
lot do not conform to the property development standards of the
zoning distr.ict and that any additions in the future would require
compliance of all the present structures on the property and also
recommended that the Board defer its decision on this matter for two
weeks, in order to allow for further research, and recommended that
the hearing remain open for written testimony until February 29,
1984;
The Board having considered the matter, IT IS ORDERED that
the decision on the appeal of Maurice and Marlana Woulf from the
Board of Appeals decision on variance Application Number 1067-83 of
Robin Lvnn Goepfert is DEFERRED to March 6, 1984, at 9: 00 a.m.

Closed Session
At 12: 00 Noon the Board recessed to meet in Closed
Session in Room 105, County Administration Building, Martinez,
California to discuss Personnel and Litigation matters.
At 2:45 p.m. the Board reconvened in its Chambers and
continued with the calendared items.
