SUBJECT: Response to January 10, 1984 Board Order referring letter from
Dan Bifulco, President, Hale Wai Homeowners Association
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION
Acknowledge receipt of report as the governing body of Contra Costa County Flood
Control and Water Conservation District.
BACKGROUND
Our first contact of record with the Hale Wai Homeowners Association was April 2, 1982.
Dave Jewett went to the site and reported that the bank failure appeared to be caused
by excessive groundwater and not creek .bank erosion.
The deadline for the Soil Conservation Service (SCS) Emergency Watershed Program was
March 31, 1982. This deadline was set in order to insure that those who qualified for .:
the aid would have their repairs completed before the next rainy season. It was also
believed that the bulk of the damage had occurred in the January storms and that .the
most severely affected homeowners had already reported their situation long before the
March deadline.
On July 2, 1982 the "Preliminary Soil Engineer's Report and Repair Recommendations for
the Hale Wai Condominiums, 1470 Danville Boulevard, Alamo, California" was published by
Diablo Soil Engineers for the Hale Wai Homeowners Association. On page four of this
report the reasons for the failure were given as "We believe that the failed area had
been a small intermittent stream before it was filled prior to construction of Hale Wai . . .
The bank failure is in the form of a mud flow that occurred as the result of a soil
structure collapse."
Hale Wai 's contractor applied for a drainage permit in order to effect repairs on July 29,
1982. The permit was granted on September 13, 1982.
According to a letter from SCS, the Homeowners Association again contacted Flood Control
on June 18, 1983 about further damage to their property which had occurred in March of
1983. The deadline for the Emergency Watershed Program had been April 15, 1983. This
extension of the deadline had been granted because of the very late storms experienced
in this county in that year. We do not know why Hale Wai waited until June to report
their damages .
The Flood Control District acts as the local contact agency for the Soil Conservation
Service in regards to this program. In 1982 and 1983 we referred anyone who wished to be
considered for the program to SCS for consideration. The setting of deadlines was
jointly agreed to by Flood Control and SCS. Qualification of applicants was and shall
remain the prerogative of the local and regional offices of the Soil Conserv on Service.

In conclusion, we are unaware of anything we can do to help the Homeowners
Association in alleviating their bank failure situation. Local government
funding for correction of these types of problems is not available. Further,
correction of these damages countywide could amount to 10 to 20 million
dollars.
We have previously indicated to the Hale Wai Homeowners Association, through
several contacts between their representatives and staff, that the Flood Control
District is not able to financially help them in solving the bank failure
problem affecting their properties .
