SUBJECT: ADOPT Resolution No. 2008/*** accepting the Preliminary Engineer's Report for Contra Costa
County,Discovery Bay West Parking District Fiscal Year 2008/2009;and fixing a public hearing for
August 5,2008 to adopt the Final Engineer's Report for Fiscal Year 2008/2009,Discovery Bay area.

The Board of Supervisors of Contra Costa County FINDS THAT:
1. The Board of Supervisors declares its intention to levy and collect the annual assessments of the park and
ride maintenance fees in the existing DiscoveryBay West Parking District for the fiscal year beginning July
1,2008 and ending June 30,2009.The District was fonned August 14,2001 under the Parking District Law
of 1951.
2. The improvements to be maintained through the Discovery Bay West Parking District consist of the
operation, maintenance and servicing of an 86,000 square foot park and ride parking lot.
3. The Public Works Director has filed with the Clerk of the Board the Preliminary Annual Eng.ineer's Report.
This report contains a description of the iriiprovements, the boundaries of the assessment district, the
proposed assessments upon assessable lots and parcels of land within the assessment district,and the Fiscal
Year 2008/2009 proposed budget.

SUBJECT: ADOPT Resolution No. 2008/49 ccepting the Preliminary Engineer's Report for Contra Costa
County,Discovery gay West Parking District Fiscal Year 2008/2009;declaring the intent to levy and
collect assessments and fixing a public hearing for August 5, 2008 to adopt the proposed annual
assessments and completing public noticing, adopting the Final Engineer's Report and authorizing
the charges to be placed on the Fiscal Year 2008/2009 tax roll, Discovery Bay area. (District I1I)

4. Based upon its review of the Preliminary Engineer's Report, the Board finds that:
(a) The parcels within the Parking District receive a special benefit over and above that received by the
general public in the form of a park and ride lot.
(b) Tile cost of the existing assessments is proportional to the benefits that this special benefit confers upon
each parcel within the district.
NOW THEREFORE, the Board FINDS, DETERMINES and RESOLVES that:
1. The Board accepts the Preliminary Engineer's Report and opens the Report to public inspection at both the
Clerk of the Board and Public Works Department offices.
2. The Board will conduct a public hearing (the "Hearing') on August 5, 2008 at 9:30 a.m. in the Board of
Supervisors' Chambers, 651 Pine Street, Martinez, California 94553.
3. At the Hearing,the Board shall consider any objections or protest to the Preliminary Engineer's Report. Tile
Board may adopt a resolution which: confirms the Preliminary Engineer's Report; finds that the Director of
the Contra Costa County Public Works Department,acting as the designated director,has concluded that the
Preliminary Engineer's Report conforms to the official assessment roll for the year in which the assessment
will be collected and, therefore, constitutes the Final Engineers Report for the Assessment; confirms the
Final Engineers Report; and authorizes the levy of the Assessment for the Fiscal Year referred to in the Final
Engineer's Report.
