HomeMy WebLinkAboutRESOLUTIONS - 07082008 - 08-467 t THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on July 8, 2008 by the following vote: AYES: Gioia, Uilkcma, Piepho, Bonilla, and Glover NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 2008/ i SUBJECT: Accepting completion of warranty period and release of cash deposit for faithful performance under the Drainage Improvement Agreement for Drainage Acceptance 03-00019'(cross--reference Subdivision 03-08508),,for project being developed by Windemere BLC Land Company, LLC, as recommended by the Public Works Director, San Ramon (Dougherty Valley) area. (District III) On September 13,2005,this Board resolved that the improvements for Drainage Acceptance 03700019 were completed as provided in the Drainage Improvement'Agreement with Windemere BLC Land Company, LLC, and now on the recommendation of the Public Works Director; The Board hereby FINDS that the improvements have.satisfactorily met the guaranteed performance standards for the period following completion and acceptance. Therefore, IT IS BY THE BOARD RESOLVED that the Public Works Director is AUTHORIZED to: • REFUND the$4,670.00 cash deposit (Auditor's Deposit Permit No. 405704, dated May 22,2003)plus interest in accordance with Government Code Section 53079,if appropriate,to Fidelity and Deposit Company of Maryland,pursuant to the Drainage Improvement Agreement and Ordinance Code Section 94-4.406. (District III) DATE: July 8, 2008 PAGE: 2 BE IT FRUTHER RESOLVED that upon completion of the warranty and maintenance period, the developer, Windemere BLC Land Company, LLC, shall retain the drainage improvements for maintenance and ownership in accordance with the Geologic Hazard Abatement District (GHAD) plan of control, and until accepted by the GHAD'or the City of San Ramon. BE IT FURTHER RESOLVED that the warranty perior has been completed and the Drainage Improvement Agreement and surety bond,bond no.08641806,dated May 14,2003,issued by Fidelity and Deposit Company of Maryland, are exonerated.
