SUBJECT: Accepting completion of private improvements, Subdivision 02-08669, for project
being developed by Brookfield Ambridge, LLC, San Ramon (Dougherty Valley)
area. (District III)
These private improvements are approximately located near Watermill Road.
The Public Works Director has notified this Board that the improvements in Subdivision 02-
08669 have been completed as provided in the Subdivision Agreement with Brookfield Ambridge,
LLC, heretofore approved by this Board in conjunction with the filing of the Subdivision Map.

being developed by Brookfield Ambridge, LLC, San Ramon (Dougherty Valley)

NOW THEREFORE BE IT RESOLVED that the private improvements have been
COMPLETED as of August 15, 2006 thereby establishing the six-month terminal period for the
filing of liens in case of action under said Subdivision Agreement:

BE IT FURTHER RESOLVED the payment(labor and materials) surety for$463,900.00,
Bond No. 586 089 14 issued by the above surety be RETAINED for the six month lien guarantee
period until February 15, 2006, at which time the Clerk of the Board is AUTHORIZED to release
the surety less the amount of any claims on file.
BE IT FURTHER RESOLVED that Bloomfield Lane, Highgrove Way, Hanover Drive,
Brighten Street, Ashfield Lane, Hampshire Way, Savoy Lane, Landsdowne Way, Windemere
Parkway, Camberly Lane, Leyton Drive, and Hastings Lane for the hereinafter described private
roads,as shown and dedicated for private use on the Final Map of Subdivision 02-08669 filed March
4, 2003, in Book 451 of final maps at Page 47 Official Records of Contra Costa County, State of
California, have been COMPLETED and are NOT ACCEPTED, at this time.

BE IT FURTHER RESOLVED that there is no warranty period required, and the Public
Works Director is AUTHORIZED to refund the $9,300.00 cash security for performance
(Auditor's Deposit Permit No. 399708, dated January 30, 2003) plus interest in accordance with
Government Code Section 53079, if appropriate, to Brookfield Ambridge, LLC, pursuant to the
requirements of the Ordinance Code; and the Subdivision Agreement and surety bond,Bond No.
586 089 14, dated January 31, 2003 are exonerated.
All deposit permits are on file with the Public Works Department.
