Cade §27281 ) of Said Road RESOLUTIGN SUMMARILY ABANDONING A PORTION Pis~ MARSH CREEK RCAO (COUNTY ROAD NO. 3971-A), aRENTUMV AREA, AND ACCEPTING A CEEB; FOR THE REL�aVATE:J PORTION s.t`;"' SAID ROAD The board of Supervisors of #",+'antra Cow C>i-U'nty " 'SrI eT^r A portion of an existing County road known as Marsh Creek Road (County Road No. 3971-A), Brentwood Area, in the County of Centra Caste, has been superseded by relocation. Therefore, it is proper that said portion of Marsh Creek Road as described in Exhi lei t :%", attached hereto and by this reference incorporated her in, be summari l y abandoned as provided in Streets and Highways Code, Section 960. 1 . Said abandonment will not cut off access to the property of any person which, prior- to such relocation, adjoined the highway. This Board hereby orders that the portion of harsh Creek Road described in Exhibit 0" be s;.mmari l y abandoned. The Clerk of this Board is hereby directed to cause a certified copy of this Resolution to be recorded in the office of the County Recorder of Contra Costa County. The Contra Costa County Flood Control and Water Conservation District has acquired and tendered to this Board a deed dated April 24, 1967, for the relocated portion of said road. This Board hereby accepts the: deed dated April 24, 1967, for the relo- cated portion of Marsh Creek Road, and this Board hereby directs its Clerk to so certify thereon and to record the same in the office of the County Recorder of Contra Costa County. (Oakland) Flood Control District Abandoned Portion of Marsh Creek :Road Road No. 3971 -A EXHIBIT "A" A portion of Section 35, Township 1 North, Range 2 East, Mount Diablo Base and Meridian described as follows : That portion of Marsh Creek Toad superseded by- relocation, beim approximately2, 100 feet in length, lying northerly of the bearing North 5° 5€, 26" East and lying southwesterly of the bearing North 520 03' 45" 'West, as said bearings are described in the deed to Contra Costa County Flood Control and 'Water Conservation Distract, recorded January 31, 1964 in Volume 4544 of Official Records at page 61.6, Contra Costa County Records . EXCEPTING AND RESERVING THEREFROM, pursuant to the ;provisions of Section 959.1 of the Streets and Highway Code, the easement and right at any time or from time to time for the owner of an existing facility used for utility purposes, including but not limited to transmission and distribution lines for electric power to maintain, operate, replace, remove, renew, and enlarge existing lines of pipe, conduits, cables, poles, wires and other convenient equipment and fixtures for the operation of existing facilities, including access to work on the facilities and to protect the facilities from all hazards, in, upon, under and over the northerly 450 feet of the road hereinbefore de- scribed to be abandoned.
