HomeMy WebLinkAboutRESOLUTIONS - 09132004 - 71-720 IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STAT: ' OF CALIFORNIA In the Matter of the Proposed } onumen.t Boulevard Boundary RESOLUTION NO. 71I720 Change by Transferring err. ink; the ) Monument Boulevard Property' } (Cov.C. §535273 , 35276, from the City of Pleasant Hill ) 35278, 35279) to the City of ''Concord ) } RESOLUTION APPROVING THE MONUMENT BOULEVARD BOUNDARY CHANCE The Board of Supervisors of Contra Costa County RESOLVES THAT: On June 1 , 1971, the City of Concord filed with the Executive Officer of the Local Agency Formation Commission an application for the transfer of the Monument Boulevard property , as described in Exhibit "P" , attached hereto and, by this reference Incorporated herein, from the City of Pleasant Hill to the City of Concord The Local Agency Formation Commission approved the proposed transfer of the territory on July 7 1911. . The City Council of the City of Concord by Resolution No. 4411 passed and adapted on July 26 , 1971, has consented to the ; proposed transfer of property, described in Exhibit "A" , from Pleasant Hill to the City of Concord. Said ,resolution was filed with the Board of Supervisors on August 10 , '1971. The City Council of the City of Pleasant Hill- , by Resolution No. 56-71, passed and adopted on May 3, 1971 ,, has consented to the transfer of property , described in Exhibit "A", to the City of Concord. Said resolution was filed with the ;Board of 'Super- visors on August 16 , 1971 . The Clerk of the Board of Supervisors fixed 10: 110 a.m. , on Tuesday, November , 2 , 1971, as the time for a public hearing on the proposed transfer of territory. Notice of said hearing was dull= given by publication in the "Concord Transcript" and the "Contra Costa Times" and by mailing a copy of such notice to the City Councils of the Cities of Concord and Pleasant Hill. At the time and place set for said hearing, the Board of "Super- visors called for evidence or protests and heardand duly considered' such evidence and protests . This Board hereby finds that no ma„ar ty protest has been made , that the territory to be transferred is uninhabited and that no landowner therein filed a urri.tten protest. This 'Board, RESOLUTION >No. 71/72 pursuant to Article 4.5 of Chapter 1 of Part 2 of Division 2 of Title 4 of the Government Code (commencing with, Section 35270). hereby orders the transfer of the territory described in attached Exhibit "A" from the City of Pleasant Hill to the City of Concord without election. The Clerk shall certify and transmit conies of this resolution to the Secretary of Stat; and to the City Councils of the Cities of Concord and. Pleasant Hill, The Clerk, pursuant to Government Code Section 519 0, shall file copies of this resolution and the attached map with the State Board of Equalization in Sacramento and the County Assessor. The Clerk, pursuant to Government Code Section 34080, shall file with the County Recorder an affidavit of completion, which shall have attached to it this resolution and the certificate of the Secretary of State describing the document filed in his office which is necessary to complete the proceedings, and the date of such f i 1 ing, PASSED ANIS ADOPTED by this Board on November 2, 1971.
