HomeMy WebLinkAboutRESOLUTIONS - 09132004 - 71-664 RESOLUTION NO. 71/664 RESOLUTION DETERMINING INITIAL VIEW OF LEGISLATIVE BODY THAT THE PROVISIONS OF DIVISION 4 OF THE STREETS AND HIGHWAYS CODE WILL NOT BE VIOLATED' WHEREAS, on the 5th day of October, 1971, the Board of Supervisors of the County of Contra Costa, State of California, adapted its Resolution No. 71/66'l.�► entitled "Resolution of Preliminary Determination of Legislative Body under 'Special Assessment Investigation, Limitation and Majority Protest Act of 1931., ' " in accordance with Sections 2820, 2821, 2822 and 2823 of said Act; NOW, THEREFORE, IT IS HEREBY RESOLVED and determined by the Board of Supervisors of the County of Contra Costa, State of California, than, after taking the steps provided by said Sections 2820, 2821, 2822 and 2823 of said Act hereinabove re- ferred to, it is the initial view of this legislative body that the contemplated improvement described in said Resolution No. 71/663. above referred to is one in which the probable assess- ments will not exceed the limitations set up in Division 4 of the Streets and Highways Code and otherwise known as the "Special Assessment Investigation, Limitation and 'Majority Protest Act o 1931. " and BE IT FURTHER RESOLVED that the County Clerk of the County of Contra Costa is hereby directed and ordered to give notice of the contemplated action of this Board of Supervisors by mailing grepaid• postcards, giving notice of the finding and proposed Y v} action of this Board of Supervisors. Said card shall be mailed to each person to whom land in the proposed assessment district is assessed on the last 'equalized county assessment roll available on the date the notices are mailed, at his or her address as shown upon such roll and to any person, whether owner in fee or having a lien upon, or legal or equitable interest in, any land within the proposed district who has filed with the Clerk his or her name and address and a designation of the band in which he or she is interested. Said notice shall be in the form provided by Part 7 of Division 4 of the Streets and Highways Code of the State of California, otherwise known as the "Special Assessment Investigation,Limitation and Majority Protest Act of 1931. " I HEREBY CERTIFY that the foregoing resolution was duly and regularly adopted by the Board of Supervisors of the County of Contra Costa, State of California, at a regular meeting thereof, held on the 5th day of October, 1971, by the following vote, to wit: AYES: Supervisors A. M. Diss, , J. E. Moriarty, W. N; Boggess, J. P. Kenny. NOES Supervisors None. ABSENTS Supervisors E. A. Linschei.d. W. T. PAASCH, County Clerk, Contra Costa County, California Miriam A.
