IN THE MATTER. OF THE CONSTRUCTION OF IMPROVEMENTS
IN ASSESSMENT DISTRICT NO. 1971-1, KENSINGTON
DRAINAGE, COUNTY OF CONTRA COSTA, STATE OF CALIFORNIA
BE IT RESOLVED by the Board of Supervisors of the County
of Contra Costa, State of California, that it is the intention
of said Board of Supervisors to order the following improvements
to be made in Assessment District No. 1971-1, Kensington Drainage,
County of Contra Costa, State of California, to wit:
The work consists of the construction of storm
drain pipe , drain inlets, manholes, pavement re--
placement, installation of subdrains and related
facilities and appurtenances in the Kensington
Area of Contra Costa County, California, as shown
on the General Plan of Improvement, together with
the installation of street lighting electroliers
on Arlington Avenue between the Contra Costa
County line and the El Cerrito City limits.
BE IT FURTHER RESOLVED that said improvements be con-
structed in said streets, avenues, roads, lanes , courts, places
and/or public ways hereinabove described and in the particular
locations set forth and shown on the plan hereafter referred to
together with the construction of all appurtenances thereto, includ-
ing necessary fittings, trenchings, grading and regrading, excava-
tion and fill, removal of obstructions, connections to existing
services, 'back filling, reconstruction of existing ground sur--
face as required to conditions existing prior to commencement
of construction, all in the particular locations as the same are
shown on the plan hereafter referred to,
That the location of work to be constructed pursuant
to this Resolution of Intention is shown upon the plan which

has been filed in the office of the County Clerk of the County
of Contra Costa on the 5th day of October, 1971, and is entitled,
"General Plan of Improvements to be made in Assessment District
1971-1, Kensington Drainage Improvements, County of Contra Costa,
State of California," and said plan is referred to for the speci-
fic location of the works and structures to be constructed.
That the structures and work and improvements herein
described are to be constructed to the grades shown upon the General
Plan of Improvements on file in the office of the County Clerk of
the County of Contra Costa.
All of said work will be done to said lines and grades.
All of said work shall include, without duplication,
any and all streets, intersections, terminations and opposite
terminations occurring within the limitations of said work.
The attention of all persons is directed to the fact
that all of said classes of work above described may not be con-
structed upon all of the streets and/or public ways above described
in their entirety, but only upon the particular locations as shown
on the plan hereinabove referred to, to which the attention of
all persons is directed for a description of the work, location
of the several classes of work, a description of the classes of
work to be done upon each of the several public streets or rights--
of-way named, a description of the streets and -rights-of-way,
and for all other information contained in the said plan herein-
above referred to pertinent to the doing and completion of the
work and improvements herein proposed,
BE IT FURTHER RESOLVED that the Board of Supervisors of

the County of Contra Costa hereby makes the expenses and costs
of said .improvements chargeable upon a district, which said dis-
trict said Beard of Supervisors hereby declares the district bene-
fited by the improvements

include that territory in the County of Contra Costa, State of
California, which is shown on that certain map on file in the
office of the County Clerk of the County of Contra Costa, and
which is entitled and described, "Proposed Boundaries of Assessment
District 1971-1, Kensington Drainage Improvements, County of
Contra Costa, State of California," and which said map indicates
by a boundary line the extent of the territory included in the
proposed district and covers all details as to the extent of the
area to be assessed; said map is , by this reference, incorporated
herein and made a part hereof.
Excepting from the area shown and delineated on said
map hereinabove referred to, the area of all public streets, avenues,
lanes, roads, drives, courts, places, public parks, and all ease-
ments and rights-of-way therein contained belonging to the public,
and also excepting from the area shown and delineated on said
map all property owned by the United States of America, the State
of California, the County of Contra Costa, and any other public
agent mandatory of the Government, school board, educational,
penal or reform institution or institution for the feeble--minded
or the insane which is in use in the performance of a public fund-
tion, and also specifically excepting therefrom any property belong-
ing to the United States of America or the State of California,
whether in use in the performance of a public function or other-
wise

NOTICE IS HEREBY GIVEN that serial bonds to represent
unpaid assessments, and bearing interest at the rate of not to
exceed seven per cent (7%) per annum, shall be issued herein in
the manner provided in Division 10 of the Streets and Highways
Code, the Improvement Bond Act of 1915, the last installment of
which shall mature -nine (9) years from the 2nd day of July next
succeeding ten (10) months from their date.
Proceedings for all work shall be taken pursuant to
the Improvement Act of 1911, and the bonds hereinabove described
shall be issued under the provisions of the Improvement Bond Act
of 1915 as heretofore described,
NOTICE IS HEREBY GIVEN that on Tuesday, the 30th
day of November, 1971, at the hour of 11 :00 o'clock A.M, .of said
day, at the meeting place of the Board of Supervisors of the
County of Contra Costa, located in the Contra Costa County Adminis-
tration Building, Martinez , California, any and all persons having
any abjection to the proposed improvements, or any objections
to the grades to which said work is proposed to be done, or to
the boundaries of the district proposed to be assessed to pay
the cost and 'expenses thereof, may, appear before said Board of
Supervisors of the County of Contra Costa and show cause why said
improvements should not be carried out in accordance with this
Resolution of Intention, and may present written protest, not
later than the hour hereinabove set for hearing, against the doing
of said work:, the grades to which said work is to be done, or
the extent of the territory to he assessed to pay the cost and
expenses thereof;
The County Clerk of the County of Contra Costa shall

cause this Resolution of Intention to be published twice in the
THE RICHMOND INDEPENDENT, a newspaper of general circulation,
circulated in the County of Contra Costa, which said newspaper
is hereby designated as the newspaper in which shall be printed
and published all notices, resolutions, orders and other matters
required to be published in the proceedings taken pursuant to
this Resolution of Intention and under the provisions of said
Improvement Act of 1911, and amendments thereto; the first publi-
cation of said notice shall be not less than ten {1p} days prior
to the date herein fixed for hearing on this Resolution of Inten-
tion;
The Engineer of Work shall cause to be conspicuously
posted along the line of said contemplated work and improvement,
and on all the open streets within the assessment district, notice
of the passage of this Resolution of Intention in the time, form
and manner required by law.
The County Clerk of the County of Contra Cpsta is hereby
directed to mail a copy of this Resolution of Intention, postage
prepaid, to all persons owning real property proposed to be assessed,
whose names and addresses appear on the last equalized assess-
ment roll or as known to said County Clerk, said mailing to be
at least fifteen days prior to the day herein fixed for hearing
on this Resolution of 'Intention, all in the time, form and manner
prescribed in said Improvement Act of 1911, as amended.
NOTICE IS HEREBY GIVEN that the total estimated cost
of said work .is $894 ,610.40.

I HEREBY CERTIFY that the foregoing resolution was duly
and regularly adopted by the Board of Supervisors of the County
of Contra Costa, State of California, at a regular meeting thereof,
held on the 5th day of October, 1971, by the following votes to wit:
