HomeMy WebLinkAboutMINUTES - 02141984 - T.4 ry THE BOARD OF SUPERVISORS CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on February 14 , 1984 by the following vote: AYES: Supervisors Powers , Fanden, Schroder, McPeak, .Torlakson NOES: None ABSENT: None SUBJECT: Hearing on recommendation of the County Planning Commission with respect to rezoning application 2574-RZ , and Development Plan 3044-83 , filed by Woodhill Development Company , in the West Pittsburg area. This being the time fixed for hearing on the recommen- dation of the County Planning Commission with respect to the application filed by the Woodhill Development Company, (applicant/ . owner) , ( 2574-RZ) to rezone land from Multiple Family Residential District (.M-29) to Planned Unit Development (.P-1) and Final Development Plan #3044-83 for 200 unit condominiums ; and Harvey Bragdon, Assistant Director of Planning, having described the property site and having advised that a Negative Declaration of Environmental Significance was filed for the proposal; and The Chairman having opened the public hearing; and Lee A . Babbitt , representing the Woodhill Development Company, having appeared and described the proposed Planned Unit Development , and having urged the Board to approve the rezoning application, and Development Plan; and Supervisor Torlakson having addressed the issue of uniform and equitable fees to be imposed for fire f acilities ' in the building permit stage of the development ; and Lee A . Babbitt having expressed his concern that a maximum amount per unit be established at the time of approval of the application for rezoning and the Final Development Plan, and then deferring payment of the fee until the building permit stage ; and Supervisor Torlakson having recommended that a condition be developed along with the approval of the rezoning application whereby the applicants would be requested to abide by the policies of the Fire Facilities Element of the. County General Plan with a limitation of not more than $50 . 00 per lot to be collected at the building permit stage of the project ; Board members having considered the matter, IT IS ORDERED that rezoning application 2574-RZ and Development Plan #3044-83 is APPROVED as recommended by the County Planning Commission subject to conditions imposed by the Planning Commission as set forth in Exhibit A attached hereto. and by reference made a part hereof , and the Board hereby adopts the Planning Commissions findings , as set forth in its Resolubtion Number 13-1984, as its determina- tions for this decision. 00031 IT IS FURTHER ORDERED that the recommendation of Supervisor Torlakson that a condition of approval be developed, whereby the applicant must agree to abide by the policies of the Fire Facilities Element of the County General Plan with a $50. 00 limitation per unit to be collected at the building permit stage if the project is approved . This approval is based on the revised Preliminary Development Plan and Final Development Plan dated received by the Planning Department December 1, 1983. 2. This approval is for a maximum of 200 dwelling units based on the revised Final Development Plan and Rezoning dated December 1, 1983. 3. Conditions, Covenants and Restrictions shall be submitted prior to recordation of the Final Map for Subdivision 6392. 4. Parking outside of specifically designated areas is prohibited. The C.C. and R's shall indicate a prohibition against parking in non-designated areas. 5. The time to activate the approval of the Development Plan .(3044-83) shall run concurrently with Subdivision 6392 and any subsequent extensions. 6. Fence design and location shall be submitted for review and approval of the Zoning Administrator. 7. Prior to the issuance of a grading permit, final grading shall be submitted for review and approval of the Planning Department. 8. The grading for units 1-8 in Unit No. 1 shall be feathered. The elevation differential between Units 1-8 and 9-16 and between 1-8 and 49-52 shall be no greater than 6 ft. 9. Design and height of the crib block shall be subject to review and approval of the Zoning Administrator. 10. All utilities shall be underground. The project shall be served by a cable television underground system. No individual antennae shall be permitted. 11. The project site shall be served by Sanitation District 7A. Each individual living unit shall be served by a spearate sewer connection. 12. Water supply serving the properties concerned shall be by Southern California Water Company. Each individual living unit shall be served by a separate water connection. 13. The utility boxes and air conditioning units shall be located away from the entrance to the dwelling units or they shall be screened from view 14. A color board and material sample shall be submitted for review and approval of the Zoning Administrator. 15. A final landscape plan for the interior area between the units shall be submitted for review and approval of the Zoning Administrator. A. A directory to the complex shall be installed at the main entrance. 17. Comply with the requirements of Public Works Dept. , as follows : A. Unless exceptions are specifically granted, comply with the requirements of Division 1006 (Road Dedication. and Setbacks) of the County Ordinance Code. This includes the following: 1. Convey to the County, by Offer of Dedication, 5 feet of additional right of ►;ay along the frontage of Canal Road as required for the planned future width of 60 feet. 2. Construct curb, 4-foot 6-inch sidewalk (width measured from curb face), necessary longitudinal and transverse drainage, and necessary pavement widening along the frontage of Canal -Road. The face of curb shall be located 20 feet from the centerline of the street.. 3. Install street lights on Canal Road and the eastern terminus of Suumerfield Road. The final number and location of the lights will be determined by the Traffic Engineer. 4. Relinquish abutter' s rights of access along Canal Road with the exception of the access ways. B. In accordance with Section 82-2.014 of the County Ordinance Code, this development shall conform to the requirements of Division 914 (Drainage) of the Subdivision Ordinance. The requirements of Section 914-2.006, "Surface Water Flowing from Subdivision," is amended as follows: 1. If, at the time of the filing of the final map or the issuance of a building permit, whichever occurs first, Drainage Area 48A has not been formed, the developer shall be required to install onsite storm improvements with the capacity to handle a total storm flow of 120 cfs and bond the downstream improvements from Willow Pass Road down to, but not including, the drain under the AT&SF railroad track. 2. If, at the time of the filing of the final map or the issuance of a building permit, whichever occurs first, Drainage Area 48A has been formed, the developer shall be required to: (a) Pay the adopted drainage fee (estimated to be 26¢ per square foot of impervious surface area) . This fee will be used to construct drainage improvements downstream of Willow Pass Road. (b) Install on site storm drains in accordance with the Drainage Area plan tQ handle the ultimate storm flow of approximately 45 cfs. The developer shall also be required to accommodate the additional interim storm flow of 75 cfs. The developer can accommodate this additional storm flow by installing 000334 , ... 2574-RZ & 3044-83 - Pg. #3 larger storm drains than required by the Drainage Plan, or some other alternative subject to approval by the Public Works Department. The costs of installing the storm drains required by the plan to accommodate the ultimate 45 cfs flow will be subject to the reimbursement policy adopted for the Drainage Area 48A plan after the entire system downstream of the freeway is in place. The cost of accommodating the additional interim storm flow will not be reimbursable . (c) Design and install Line D of the Drainage Area 48A plan so that the HGL is low enough to allow drainage from the Mims Drive area. C. Prevent storm drainage, originating on the property and conveyed in a concentrated manner, from draining across public sidewalks or driveways. D. Dedicate drainage easements and observe structure setbacks pursuant to the requirements of the Ordinance Code for onsite storm drains as specified by the County Public Works Department. E. Furnish proof to the Public Works Department, Land Development Division, of the acquisition of all necessary rights of entry, permits and/or easements for the construction of off-site, temporary or permanent, road and drainage improvements. F. Install all new utility distribution services underground. G. Submit improvement plans prepared by a registered civil engineer to the Public Works Department, Land Development Division, for review; pay the inspection, plan review and applicable lighting fees. These plans shall include any necessary traffic signing and striping plans for review by the County Traffic Engineer. The improvement plans shall be submitted to the Public Works Department, Land Development Division, prior to the issuance of any building permit. The review of improvement plans and payment of all fees shall be completed prior to the clearance of any building for final inspection by the Public Works Department. If final inspection is requested prior to construction of improvements, the applicant shall execute a road improvement agreement with Contra Costa County and post the bonds required by the agreement to guarantee completion of the work. H. Comply with the Contra_ Costa County Sanitation District No. 7A Ordinance requirements. I. Construct the traffic signal at the intersection of Canal Road and Bailey Road and receive a $26,500 plus; plus additional potential reimbursements as potential properties with pertinent traffic impacts develop in the area, OR, at the developer's option, contribute $78,500 toward the cost of the signal . 00033 ;� . .. ,..i 2574-RZ & 3044-83 - Pg. #4 J. Construct frontage improvements consisting of construction of a 4-foot 6-inch sidewalk, necessary pavement widening, curbs, longitudinal and transverse along the north edge of Canal Road from the site to the existing sidewalk which ends approximately 160 feet west of Bailey Road. The face. of the curb shall be located 20 feet from the centerline of the street. These frontage improvements must be within the existing right of way. K. Construct left-turn channelization on Canal Road at the proposed access way, including the necessary pavement widening. 18 . The applicant shall comply with the policies of the Fire Facilities Element of the County General Plan by paying a maximum of $50. 00 per unit, "said fee to be paid at the time of application for building permit. " The following statements are not conditions of approval, however the applicant should be aware of these comments prior to attempting to secure building permits. A. Applicant shall comply with the requirements of the County Health Department, Sanitation District 7A, Riverview Fire District, East Bay Municipal Utility District and Contra Costa Water District.
