RECOMMENDATION
It is' recommended by the Public Works Director that the County portion of community access
funds accruing to the County as a result of Concord TV Cable and General Electric Cablevision
opting under Government Code Section 53066.1 be remitted to the County's Community Access
Trust Fund.
BACKGROUND
On January 9, and January 31, 1984 the Board of Supervisors referred to the Public Works
Department letters from Concord TV Cable and General Electric Cablevision Corporation
of Walnut Creek advising that each of these corporations were exercising their option
pursuant to Government Code Section 53066.1 to place their operations under State regulation.
A review of the affidavits filed indicate that these two corporations meet the criteria
for deregulation in Section 53066.1.
The impact of this action on the County is slight in that Concord TV Cable and General
Electric primarily serve the cities of Concord and Walnut Creek respectively with Concord
having 1,000 subscribers in the unincorporated area and General Electric having 1,800
subscribers in the unincorporated area.
Of concern to the County is the Code section requiring a deregulated cable company to
contribute 50 cents per subscriber per year for community access. The cable industry
in California has in conjunction with California Public Broadcasting Corporation established
the Foundation for Community Service Cable Television as a recipient of these funds.
The funds are distributed in the form of grants to deregulated communities throughout
the states. An alternate section of the Code allows for 40 cents per subscriber per year
to be funded to the local franchising authority (in this case, the County) and 10 cents
to the statewide foundation. Contra Costa County already receives community access funds
from other cable television operators with franchises in the unincorporated area of the
County. These funds are held in trust and will be distributed in the form of grants
to facilitate community access and ]information in the unincorporated areas
throughout the County.
