Tract 3888. DRAINAGE ZOITE
The Board of Supervisors of the Contra Costa County Storm Drainage
District RESOLVES THAT:
The Contra Costa County Storm Drainage Distract Act , herein-
after referred to as Act, provides authority for the Board of
Supervisors to establish zones and adopt projects within the Contra
Costa County Storm Drainage District . Pursuant to 69-8 of the
Act , the Board of Supervisors of Centra Costa County is ex officio
the Board of Supervisors of trate Contra. Costa Counter .Storm Drainage'
District.
The Board of Supervisors has heretofore considered the
proposed formation of a zone consisting of the real, property'; de-
scribed in Exhibit "A" , attached hereto and incorporated by refer-
ence"
efer-ence, for the purposes and objects hereinafter set forth. Upon its
own motion, and pursuant to 69--'18.5 of the Act , the Board of
Supervisors has heretofore required a report from the Chief Engineer
of the Contra Costa County Flood Control and Nater Conservation
District containing the information' set forth in §69-1of the Act .
On July 6, 1971, the said Chief Engineer submitted to the
Board of Supervisors a report on the proposed Zane No. 108A within'
Contra Costa County Storm Drainage District which contains :
(a) A general description of the project and the work of
Improvement to be done,
(b) a general description of the lands , rights of way, ease-
ments, and property to be taken, acquired, or injured. In carrying
out such work,
(c) an estimate of the coast of such work incl.udi.ng, an estimate
of the cost of lands , rights of way, easements , and property
proposed to be taken, acquired, or injured in carrying out such
work, and also of all incidental expenses and of all operating,
maintenance and other costs likely to be incurred in connection
therewith'; which said report is hereby referred: to for further
particulars ,
The Board of _Supervisors finds that the project , hereinafter
referred to, is for the benefit of a. single zone consisting of all
of the real property described in Exhibit "A"

The proposed zone is to be formed for the purpose of maintain-
ing Marsh Creek channel and overflew areas within the real property'
described in Exhibit "A" , as specifically described in the report
of the Chief Engineer, dated June 1971, which report has been
adopted by the Board of Supervisors . No new improvements are pro-
posed, and there is no plan for any such improvements. The location
and extent of such work will be determined when and if it becomes
apparent that the work is necessary, for the preservation and main-
tenance of the existing natural, channel of Marsh Creek and overflow
areas 'thereto within the real property described in Exhibit "A" .
The cost is to be borne by the zone proposed to be formed, should it
be formed. A map of the general location and general construction
of the proposed project Is on file with the Clerk of the Beard of
Supervisors at his office in the Administration Building, Martinez,
California, and posted on the' Pacific Cas and Electric Company pole,
on Morgan' Territory Road, 20 feet more or Less southerly, of the
northern intersection ;of the zone and Morgan Territory Road right of
way which is approximately two miles south of the intersection of
Marsh` Creek Road and Morgan Territory Read, ' a public place lying;
within said zone
At 2: 30 P.m. on Tuesday, August 3, 1971, in the; Chambers of
the Board of Supervisors , Administration Building, Martinez,
California, the Board of Supervisor=s will conduct a public hearing
on the proposed formation of said. zone and the adoption of a
project for said zone. At said hearing, the Board of Supervisors
will hear and pass upon any and all written or oral objections to
the formation of the zone and to the adoption of the proposed
project for said zone. Upon the conclusion of the hearing the
Hoard may abandon the proposed zone or project or proceed with the
same.
The Clerk of the Board of Supervisors is directed to publish
this :Notice and Resolution once a week for two ('2) successive weeks
prior to the hearing in the "Concord Transcripts`, a ;;newspaper of
general circulation, circulated in the area proposed to be formed:
into such zone.'
The Clerk of the 'Board of Supervisors is further directed to
mail notices of the proposed formation of such zone to all ,persons
owning real property lyi.ng', within such zone, whose names and .ad-
dresses appear on the last, equalized County assessment roll for
County taxes prior thereto,, or on the Board roll last transmitted
to the County by the State` Board of Equalization prior thereto.
The notices so railed shall contain the information required by
§E9-18 of the 'Act.
PASSED AND ADOPTED on July 6, 1.971, by the Board of Super-
visors of Contra Costa County as ex officio the Board of" Supervisors
of the Contra Cost>a. County ' Storm Drainage District.

That parcel of land located in the County of Contra Costa, State of
California, described as follows;
Beginning at the center of Section 33, Township I North, Range 1 East,
Mt. Diablo 'Base and Meridian, said point being marked by a concrete mon-
ument; thence, from said point of beginning, North 10 331 1311 East 1315.64
feet; thence South 88" 32' 1011 East 1307.46 feet; thence South 10 171 3411
West 1315.44 feet; thence South 88° 331 4511 East 1313.44 fest to the east
tine of Section 33; thence, along said east line, South 10 181 2211 West
1348.72 feet; thence North 870 461 2811 West 1718.67 feet; thence South
8° 361 431' East 31 .90 feet.- thence South 130 081 0611 West 227.56 feet;
thence South A° 53' 2111 West 67. 12 feet; thence South 10 481 4911 West
79.38 feet; thence North 890 131 22" West 395.60 fest to the east line
of Morgan Territory Road as said road is shown on the map of Subdivision
No. 3888; thence along said east line, North 4° 331 31t1 West 774.77 feetil
thence, along a tangent curve to the left, with a radius of 950 fest,
through a central 'angle of 630 431 5011, an arc distance of 1056.69 feet
to a print of reverse curve; thence, along a curve to the right, with a
radius of 600 feet, through s central angle of 28° 33' 09t1, an arc dis-
tance of 299.01 feet; thence, leaving said east line of Morgan Territory
Road, South 88° 331 451' East 469.53 feet to the point of beginning.
