The Contra Costa County Storm Drainage District Act , herein- after referred to as Act, provides authority for the Board of Supervisors to establish zones and adopt projects within the Contra Costa County Storm Drainage District. Pursuant to §69-8 of the Act , the }hoard of Supervisors of Contra Costa Counter is ex officio the Board of Supervisors of the Contra Costa County Storm. Drainage District. The Board of Supervisors has heretofore considered the pro- posed formation of a zone consisting of the real property described in Exhibit "A" , attached hereto and incorporated by reference, for the purposes and objects hereinafter set forth. Upon its own ,motion, and pursuant to §69--18.5 of the Act , the Board of Super visors has heretofore required a report from the Chief Engineer of the Contra Costa County Flood Control and Water Conservation District containing the information set forth in §69- 15 of the Act . On July 6, 1971, the said Chief Engineer submitted to the Beard of Supervisors a report on the proposed Zone No. 7IA within Contra Costa County Storm Drainage District, which contains: (a) A general description of the project and the work of improvement to be done; (b) a general description of the lands , rights of way, ease- ments , and property to be ,taken, acquired, or injured in carrying out such work; (c) an estimate of the cast of such work including an estimate of the cost of Lands, rights of way, easements , and property proposed to be taken, acquired, or injured in carrying out such work, and also of all incidental expenses and of all operating;, maintenance and other casts likely to be incurred in connection therewith; which said report is hereby referred to for further particulars . The Board of Supervisors finds that the project, hereinafter referred to, is for the benefit of a single zone consisting of all of the real property described in Exhibit "A" . The proposed zone is to be farmed `for the purpose of maintaining the drainage channels within the real property described in Exhibit "A" , as specifically described in the report of the Chief Engineer, -1- RESOLUTION NO. 71/42'8 dated Juno 1971, which report has been adopted by the Board of Supervisors . No new improvements are proposed, and there is no plan for any such improvements . The location and extent of such work, will be determined when and if it becomes apparent than the work is necessary for the preservation and maintenance of the existing natural channel of Mitchell Creek and appurtenances thereto within the real property described in Exhibit "A" . The cost is to be borne by the zone proposed to be formed, should it be formed. A map of the general location and general construction of the proposed project is on file with the Clerk of the Board of Super- visors at his office in the Administration Building, Martinez, California, and posted on the Pacific Gas and Electric Company pale on the east side of Mitchell Canyon Read, 2700 feet more or less southerly of the intersection of Mitchell Canyon Road and Herriman Court, a public place lying within said zone. At 2: 15 p.m. on Tuesday, August 3, 1971, in the Chambers of the Board of Supervisors , Administration Building, Martinez, California, the .Beard of Supervisors Mill conduct a public hearing on the proposed formation of said zone and the adoption of a project for said zone . At said hearing;, the Board of Supervisors will hear and pass upon any and all written or oral objections to the formation of the zone and to the adoption of the proposed project for said zone. Upon the conclusion of the hearing the Board may abandon the proposed zone or project or proceed with the same. The Clerk of the Board of Supervisors is directed to publish this Notice and Resolution once a week for two (2,) successive weeks prior to the bearing in the "Concord Transcripts" , a newspaper of general circulation, circulated in the area proposed to be formed into such zone. The Clerk of the Board of Supervizors is further directed to mail notices of the proposed formation of such zone to all persons owning real property lying within such zone whose names and addresses appear. on the last equalized County assessment roll. for County taxes prior thereto, or on the Board roll: last transmitted to the County by the State Board of Equalization prior thereto. The notices so mailed shall contain the information required by §69-18 of the Act . PASSED AND ADOPTED on July E, 1971, by the Board of Super- visors of Contra Costa.
