HomeMy WebLinkAboutRESOLUTIONS - 09102004 - 71-415 CC-22b RESOLUTION NO. 71/415 OF THE BOARD OF SUPERVISORS OF THE COUNTY OF CONTRA COSTA CALIFORNIA DECLARING INTENTION TO LEASE COUNTY PROPERTY FOR THE CON- STRUCTION OF A BOYS' WING AND CLASSROOM ADDITION TO THE CONTRA COSTA COUNTY JUVENILE HALL AND TO LEASE BACK SUCH PROPERTY, AS IMPROVED; APPROVING FORMS OF LEASE BIDDING DOCUMENTS, SITE LEASE, FACILITY LEASE AND CONSTRUCTION CONTRACT; PROVIDING FOR PUBLIC COMPETITIVE BIDDING FOR SAID LEASES; AND FIXING A TIME FOR A PUBLIC MEETING FOR RECEIPT AND CONSIDERATION OF SAID BIDS. WHEREAS, this Board of Supervisors has heretofore determined and hereby determines that the public interest, convenience and general welfare require the construction of a Bays' Wing and Classroom Addition to the Contra Costa County Juvenile Hall, to provide housing facilities, class- rooms, detention facilities, kitchen and dining facilities , offices, outside play areas, parking and related facilities (herein called the "Project") ; WHEREAS, the County owns land adjacent to its ex- isting Juvenile Hall upon which the Project can be built, and such use is consistent with the use and purposes con- templated upon the acquisition of such real property; WHEREAS, under and pursuant to the provisions of the Government Code, this Board of Supervisors is authorized and empowered to rent to any person, firm or corporation, for a term of not to exceed forty (40) years, any real property which belongs to the County; provided that the use to which such property will be put, after construction of a building or buildings thereon, is consistent with the use or purposes contemplated upon the original acquisition of such property; and provided, further, that any instrument by which said property is let, as aforesaid, must require that the lessee therein construct on the demised premises a building or buildings for the use of the County during the term thereof and that title to such building or build- ings shall vest in the County at the expiration of the said term; and the lease shall contain such other terms and conditions as the Board of Supervisors may deem to be in the best interests of the County, NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Contra Costa as follows: 1. All of the recitals herein contained are true and correct and this Board of Supervisors so finds. 2. The real property owned by the County of Contra Costa and located therein which is proposed to be leased is described (in such a spanner so as to identify it) as follows; PARCEL ONE Being a portion of the north one--half of lot 10 of the Rancho Las Juntas partition situated in the City of Martinez, County of Contra Costa, State of California, more particularly described as follows. Commencing at a standard street survey monument at the intersection of the centerline of Glacier Drive with the south line of the parcel of land described in the deed to Contra Costa County recorded May 6, 1948 in Volume 1195 of Official Records at page 562, Contra. 2 xF :, Costa County, California as said monument is shown on the Record of Survey map recorded September 27 , 1967 in Hook 49 of License Surveyors Maps at page 37; thence from said point of commencement, S 880 461 3311 W (the bearing; S 880 46' 33" W beim; taken for the purpose of this description) along said south line (1195 OR 562) 523. 88 feet to a hub and tack; thence leaving; said south line (1195 OR 562) N 00 20' 06" E 543.41 feet, here and after referred to as the Base Line, to the true point of beginning on the most southerly wall of the Juvenile Hall Administration Building as it was known and stood on the 6th day of November 1970; thence S890 39' 5411 E along said most southerly wall 58. 40 feet to its intersection with the most southwesterly wall of the Juvenile hall Boys ' Wind; Building; as it was known and stood on the 6th day of November 1970; thence along said most southwesterly wall S 290 521 41i1 E 112. 81 feet; thence continuing along said Juvenile Hall Boys ' Wind; Buildint walls N 601 07' 19" E 56. 67 feet; thence S 290 521 41" E 50. 42 feet ; thence, N 600 07' 191' E 32. 00 feet to the most easterly corner of said Juvenile Hall Boys' Wing, Building; thence leaving said Juvenile }fall Boys ' Wing Building S 89° 39' 54" E 22.84 feet, to a line parallel and 240.00 feet easterly measured at right angles from the above men- tioned base line; thence, along said parallel line S 01 201 06" W 400.43 feet, to a line parallel and 40 feet northerly measured at right angles from the above mentioned south line of the Contra Costa County parcel (1195 OR 562) ; thence along said parallel line S 88'0 46' 33" W 260.10 feet, to a line parallel and 20. 00 feet westerly measured at right angles from above mentioned Base Line; thence along said parallel -line N 00 20' 06" E 255. 00 feet; thence, N 890 39' 511" W 95.17 feet to a line parallel and 115.17 feet westerly, measured at right angles from the above mentioned Base Line; thence along said parallel line N 0° 201 0611 E 151.45 feet to the most southerly corner of the most southeasterly wall of the Juvenile Hall Girls ' Wing Building; as it was known and stood on the 6th clay of November 1970; thence alone; said most southeasterly wall of the Juvenile Hall Girls ' axing Building N 300 32' 531' E 112. 81 feet to its intersection with the above mentioned most southerly wall of the Juvenile Hall Administration Building; thence S 890 39' 5411 E along said most southerly wall of the Juvenile Ball Administration Building 58. 40 feet to the true point of beginning. PARChL TWO A 40-foot right of way (not to be exclusive) as an appurtenance to parcel One above for use as a roadway for vehicles of all kinds ; commencing at the standard street survey monument as described in Parcel One above; thence from said point of commencement S 880 46' 33" W 30. 03 feet along the south line of the Contra Costa County Parcel (1195 OR 562) as described in Parcel One above to the true point of beginning, said point lies on the westerly line of Glacier Drive, thence continuing along said south line (1195 OR 562) S 880 46' 33" W 513.86 feet; thence, N 00 201 0611 E 40. 01 feet to said southwest corner of parcel One above, thence N 880 461 33" E along a line parallel and 40 feet northerly measured at 3 gid• n;,, • right angles from the said south line of the Contra Costa County Parcel (1195 OR 562) common to the southerly boundary line of Parcel One above 260.10. feet, to the southeast corner of Parcel One above; thence continuing; along; said parallel line N 880 461 33i1 E 254.411 feet, to the above mentioned westerly line of Glacier Drive; thence S 10 18' 20" N along said westerly line of Glacier Drive 40. 04 feet to the true point of beginning. 3. This Board of Supervisors hereby approves , adopts and specifies the following documents: (1) a Notice of Adoption of Resolution Declaring Intention to Lease County Property and Invitation to Lease Bidders , (2) In- structions to Lease Bidders, (3) a form of Lease Bid Pro- posal, (4) a form of Site Lease, (5) a form of Facility Lease, and (6) a form of Construction Contract, a copy of each of which has heretofore been submitted to and filed with this Board, to be the statement of the terms and conditions to be complied with and of the terms and con- ditions deemed to be in the best interest of the County and under and in accordance with which this Board proposes to proceed and to contract for the lease out of the site therein described, construction of the improvement therein described and lease back to the County as therein described, all under, pursuant to and in accordance with the provisions of the Government Cade and other appropriate provisions of law of the State of California, and to be the manner of conducting competitive public bidding for the leases herein authorized. The Clerk of this Board is directed to place and keep on file a copy of each of these documents in the office of the County Clerk and Ex-Officio Clerk of the Beard of Supervisors, County of Contra Costa., Room 103 , County Administration Building, Martinez, California, to be available for public inspection during the regular of- fice hours of said office. 4 j. M '.. d 4. It is expressly determined that no real es- tate broker's fee will be paid. 5. The sum of Two Hundred Ten Thousand Three Hun- dred Ten Dollars ($210 ,310) is specified as the rental to be paid to the County under the Site Lease, for the lease of the property hereinabove described, which rental shall be payable to the County in advance on or before the tenth day following commencement of the term of said lease, and the term of said lease is a period of not to exceed twenty-- seven (27') years two and one-half (2-1/2) months. 6. The terms upon which the property will be leased are specified to be payment of the Site Lease rental hereinabove provided for and execution of the Site and Facility Leases and Construction Contract hereinabove ap- proved and adopted, and construction of the Project in accordance with said Facility Lease and Construction Con- tract. 7. It is , and it is hereby declared to be, the intention of this Board to proceed with a lease of County property and execution of the Site and Facility Leases in accordance with and all as more particularly described in the documents hereinabove approved and adopted. 8. Tuesday, July 27, 1971 at 7:30 o'clock P.M. is fixed as the time and the Board of Supervisors Chambers, Room 103, County Administration Building, Martinez , Contra Costa County, California, is fixed as the place for a pub- lic meeting of this Board at its regular meeting place at which sealed proposals to lease, construct and lease back will be received and considered. 9. The Clerk of this Board is directed to dive 5 f :j -- notice of the adoption of this Resolution and of the time and place of holding the meeting at which bids will be re- ceived and considered by posting copies of this Resolution, signed by the Chairman of this Board, in three (3) public places in this County not less than fifteen (15) days be- fore the date of said meeting, and by publishing said form of Notice of Adoption of Resolution Declaring Intention to Lease County Property and Invitation to Lease Bidders once a week for two (2) successive weeks, in THE LAFAYETTE SUN, a newspaper of general circulation published in the County. Said notice shall constitute the notice to lease bidders and will be considered to have been published as required by law upon completion of said publication.
