Diablo Bar Association and urged the introduction cox" legislation to provide one additional Superior Court ,judgeship in Contra Costa County; and WHEREAS Attorney Van Voorhis pointed out that it was the position of his bar association that an additional judgeship rather than an additional Juvenile Court Referee (an alternate proposal) should be authorized because a ,judgeship was needed in terms of the amount and characteristics of the Su-oer or Court workload and because the jurisdiction of a Juvenile Cou.rtLL Referee was restricted and lacked flexibility; and WIER.EAS Attorney star Voorhis also pointed out that the endorsement of the Board of Supervisors is required before legisla- tion for the creation of a Superior Court judgeship would be considered by the California State Legislature and the Governer; and WHEREAS Supervisor A. M. pias stated that he strongly favors the appointment of one of the Contra Costa County Municipal Court judges to a Superior Court judgeship vacancy so that a realistic court workload might be established for each Ixunicipal Court judge and so that all possible savings to the taxpayers might thereby be obtained.; and WHEREAS Attorney Van Voorhis stated that the Mt. Diablo Bar Association was interested in Municipal Court consolidation and the savings related thereto and that his association and the other bar associations in the county would be quite willing to review, comment, attend hearings, and participate in any way in consideration of such consolidation proposals but that he believed the Municipal Court and Superior Court natters should be separately evaluated., and �4111EREAS Attorney Leonard Fully, Vice President o.f the Contra Costa County Bar Association, and Attorney William Resler, Secretary of the Richmond ,Bar Association, appeared and supported the position taken by the Mt. Diable Bar Association; and WHEREAS Supervisor E. A. Linscheid pointed out that the time for introduction of legislation was very limited and that while he was extremely reluctant to impose any additional burden upon the property taxpayers, it was the responsibility of the Beard of Super- visors to insure that the work of the Superior Court, in terms of an adequate number of judges , was properly accomplished; and RESOLUTION NUMBER 71/205 WHEREAS Supervisor Linscheid then roved that legislation providing for one additional judgeship for the Contra Costa County Superior Court be introduced immediately and that the matter be referred to the Administration and Finance Co_mrrnittee (Supervisor Linscheid and Supervisor J. E . Moriarty) for review and report to the Board and that, subject to the results of such review, approval of the introduction of said legislation could be reaffirmed or withdrawn, and WHEREAS Supervisor W. N. Boggess stated that he diad not agree with the position teen. by Supervisor Dias, and seconded the notion of Supervisor Linscheid, and WHEREAS members of the Board then discussed the matter in detail with Supervisor Dias reaffirming his position as heretofore stated, with Supervisor J. P. Kenny asserting that he was opposed to aforesaid motion and. believed ,further attention should be given to the ?natter of appointing an additional Juvenile Court Referee, and with Supervisor J. E. Moriarty asserting that he was in favor of the motion in view of the Superior Court workload and the need for the Hoard to face up to its responsibility in connection therewith, and WHEREAS Supervisor Kenny thereupon called for the vote on the motion of Supervisor Lin:scheid, NOW, THEREFORE, BE IT BY THIS BOARD RESOLVED that the Contra Costa County representatives in the California State Legisla- ture are R QUEESzED to introduce a, bill to provide for one additional Contra Costa County Superior Court judgeship . PASSED and ADOPTED this 34th day of March, 1971, by the following vote: AYES: Supervisors J. E. Moriarty, W. N. Boggess, E. A. Linscheid. NOES: Supervisors A. M. Dias, J. P. fenny. ABSENT: None.
