HomeMy WebLinkAboutRESOLUTIONS - 08302004 - 70-579 IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the batter of Underground Utility District No. 7, RESOLUTION NO. 70/579 Danville Area WHEREAS the Board on May 12, 1970 adopted Resolution No. 70/282 establishing Underground Utility District No. 7 extending Hartz Avenue and San Raman Valley Boulevard between Love Lane and. Sycamore Valley Road in Danville; and I�MRFA.S due to the uncertainty as to schedule for future widening of San Ramon "Valley Boulevard southerly of Denville and ,the sparseness of improved properties presently served by the utilities, it is desired to def6r the conversion of the present system to under-- ground until_ such time as the underground facilities can be located in a permanent location after right of way for widening has been acquired, to eliminate possible need for further relocation after being undergrounded; and WHMEAS Ordinance No. 68-10 does not presently provide a method for reduction in either the size of the district or scope of work to be accomplished; and WHEREAS the Public Works Director has recommended that: 1. The paragraph in said. Resolution No. 70/282 fixing the time limit for conversion of existing service to underground (fifth paragraph) be amended to read as follows 'This Board hereby fixes May 1, 1971 as the date on which affected property owners' situated northerly of the southerly line of�}property described as .Assessor' s Parcel No. 208' 060-020/60-020? (1969-1970 Roll) on the west side of San. Ramon Valley Boulevard, and those affected property owners situated northerly of the south line of Lot 77, Danville Gardens sub- division, on the easterly side of said San Raman Valley- Boulevard, must be ready to receive under- ground service and hereby orders the removal of all poles, overhead wires and associated structures and the underground installation of wires and facil- ities for supplying electric, communication or similar or associated service within said Underground Utility District No. 7 on or before July 1, 1971 . The Board hereby determines that the date for com- pletion of undergrounding of utilities in the portion of Underground Utility District No. 7 situated southerly of the hereinbefore described area, shall be July 1, 1972"; and. 2. The utility cox panies and the property owners affected. by the deferral, of work be notified by the Public Works Department; and RESOLUTION NO. 70/579 .1. The County Counsel be directed to prepare an amend- ment to Ordinance 68-10 to provide a method of modification of district boundaries or reduction of scope of Mork, etc. where such changes may be ap_prow Driate. NOW, THEREFORE$ BE IT BY THE BOARD OF SUPERVISORS RESOLVED that the recomendations of the Public Works Director are APPROVED. PASS AND ADOPTED this 8th day of September, 1970 by the following vote of the Board: AYES: Supervisors J. P. Kenny, A. M. Dias, J. E. Moriarty, E. A. Linseheid, T. J. Coll. NOES: None. ABSENT: None.
