County Sanitation District ) 56431, 56432 , 56437) No. 7-A and the Concurrent }' Dissolution of the Bella Vista } Sanitary District } } RESOLUTION INITIATING PROCEDURES FOR A REORGANIZATION BY THE ANNEXATION OF THE TERRITORY OF THE BELLA VISTA SANITARY DISTRICT TO CONTRA COSTA COUNTY SANITATION DISTRICT NO. 7-<A AND THE CONCURRENT DISSOLUTION OF THE BELLA VISTA SANITARY DISTRICT The Beard of Supervisors of Contra Costa County RESOLVES THAT: Reorganization by annexation of the territory of the Bella Vista Sanitary District to Contra Costa County Sanitation District No. 7--A and the concurrent dissolution of the Bella Vista Sanitary Distract has been proposed by the Board of Directors of the Bella Vista Sanitary District . A resolution of application for the proposed reorganization was filed by the Bella Vista Sanitary District with the Executive Officer of the Local AgencyFormation Commission on July 10, 1970. The reasons for the proposed reorganization are as set forth in the application for reorganization and are (1) that it has been determined by the .Board of Directors of the Bella Vista Sanitary District that the annexation of its territory to Contra .Co to County Sanitation District No. 7-A would be in the best interests of the residents and taxpayers' of the Bella Vista Sanitary District , as it 'would insure the continued treatment of the sewage originating within its boundaries and (2) that upon the completion of the an- nexation, there is no reason for the Bella Vista Sanitary District to remain in existence as it would serve no useful function. On August 19 , 1970, the Local Agency Formation Commission approved the application subject to the fallowing terms .and condi- tions :' I Contra Coasts, County Sanitation District No. 7-A shall be the successor of the dissolved .Bella Vista. Sanitary District . 2 Contra Costa County Sanitation District No. 7-A shall succeed to all the assets (including both real and personal property) and liabilities of the dissolved Bella Vista Sanitary District . RESOLUTION NO. 701533 -1- 3. The effective date of the annexation shall be prior to January 1, 1971, and the effective date of the dissolution of the Bella Vista Sanitary District shall be June 30 , 1971. All fees due Bella Vista Sanitary District will be collected and retained by Bella Vista Sanitary District as in its past operation, until, final dissolution. 4. The Bella Vista Sanitary District shall continue to maintain its system until. June 30, 1971 and the Contra Costa County Sani proposed reorganization must do so by written communication filed with the Clerk of the board not later than the hour set for hearing. A written protest by a landowner must contain a de- scription sufficient to identify the land owned by him. A written protest by a voter must contain the residential address of such voter. At the conclusion of the hearing, the .Board of Supervisors shall either disapprove the proposed reorganization or order the reorganization subject to the confirmation of the voters in accordance with Government Code Section 56437. The Clerk of this Board is hereby directed to publish the text of this resolution once a week for two successive weeks in the "Pittsburg Post-Dispatch", a newspaper of general circulation published in this County and circulated in the territory of each of the districts which would be affected by the proposed reorgan- ization, the first publication to be made not later than fifteen (15) days prior to the hearing date . The Clerk of this Board is also 'directed to post the text of this resolution on the bulletin board of this Board at least fifteen (15) days prior to the hearing date , and such posting will, continue to the time of the hearing. The Clerk of this Board is further directed to give notice by mailing notice of hearing at least fifteen (15) days prior to the hearing date to each affected district , each person who has filed a notice for special notice with the County Clerk, the chief petitioners and all landowners owning land within the territory of the Bella Vista Sanitary District .
