AB 2259 (Felando) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION: Adopt a position of support for SB 1347 and AB 2259. BACKGROUND: SB 1347 by Senator Carpenter and AB 2259 by Assemblyman Felando are nearly identical bills dealing with complaints about long-term health care facilities, inspections of such facilities, and the definition of what constitutes a violation of the law relative to long-term health care facilities. SB 1347 and AB 2259 both do the following: 1 . In addition to allowing any person to request an inspection in writing would allow a request to be by telephone or by personal visit and in such cases requires the State Department of Health Services to reduce the request to writing. 2. Specifically require that when conducting an on-site inspection, the State collect and evaluate all available evidence, including but not limited to observed conditions, statements of witnesses and facility records. 3. Add as Class "B" violations, ones which affect the welfare of a patient instead of just the health, safety, or security of a patient and specify that a violation of a patient's rights is a Class "B" violation. In addition, SB 1347 requires the Director, State Department of Health Services, to issue a press release to the media in the city or county where a facility is located whenever an enforcement action is taken against a long-term health care facility. To the extent that these bills tend to further protect patients in long-term health care facilities they are consistent with existing Board policy and, therefore, deserve the support of the Board of Supervisors.
