In the Matter of the Reorganization
Proposal to the Local Agency Formation
Commission for the Annexation of the
Territory of the Bella Vista Sanitary RESOLUTION NO. 70/491
District to Contra Costa County
Sanitation District No. 7-A and the
Concurrent Dissolution of the Bella
Vista Sanitary District.
This Board on July 23, 1968 having authorized Mr. Victor V.
Sauer, County Public Works Director as Engineer Ex Officio of
Contra Costa County Sanitation District No. 7-A, to negotiate, In
cooperation with the County Administrator, District Attorney ( County
Counsel) and the Auditor-Controller, terms and conditions for annex-
ation of the Bella Vista Sanitary District to Contra Costa County
Sanitation District No. 7-A; and
The Bella Vista Sanitary District on July 10, 1970 having
filed a Reorganization petition with the Local Agency Formation Com-
mission calling for the annexation of the territory of the Bella
Vista Sanitary District to Contra Costa County Sanitation District
No. 7-A and the concurrent dissolution of the Bella Vista Sanitary
District subject to certain specified terms and conditions not pre-
viously agreed to by Mr. Sauer, the County Administrator, County
Counsel and Auditor-Controller; and
The Executive Officer of the Local Agency Formation Commis-
sion having made his recommendations to the Local Agency Formation
Commission on the terms and conditions of the Reorganization, which
terms and conditions are attached hereto as "Exhibit A"; and
Said terms and conditions as recommended by the Executive
Officer of the Local Agency Formation Commission being . acceptable to
this Board, except that in No. 5 thereof where the Executive Officer
has made no recommendation on what the territory of the Bella Vista
Sanitary District shall pay to Contra Costa County Sanitation Dis-
trict No. 7-A for the right to use the existing property of said
district, it is the feeling of this Board that the sun of approxi-
mately $117,000 (as of July 1, 1970) less the value of the assets
to be transferred to -Contra Costa County Sanitation District No. 7-A
by the Bella Vista Sanitary District is a fair and equitable figure;
NOW., THEREFORE, BE IT BY THIS BOARD RESOLVED that Mr. Sauer,
in cooperation with the County Counsel, shall represent this Board
before the Local Agency Formation Commission when it considers said
Reorganization proposal and shall seek the adoption by said Commis-
sion of the terms and conditions recommended by the Executive Officer
of the Local Agency Formation Commission, except that in No. 5 thereof
IT IS RESOLVED that a figure of $117,000 ( as of July 1 1970) less
the value of the assets of the Bella Vista Sanitary District should

be sought; IT IS FURTHER RESOLVED that Mr. Sauer and the County
Counsel are AUTHORIZED to continue negotiati

EXHIBIT "A"
1. Contra Costa County Sanitation District
No. 7-A shall be the successor of the dissolved
Bella Vista Sanitary District.
2. Contra Costa County Sanitation District No.7-A
shall succeed to all the assets (including both
real and personal property) and liabilities of
the dissolved Bella Vista Sanitary District.
3. The effective date of the annexation shall be
prior to January 1. 1971, and the effective
date of the dissolution of the Bella Vista
Sanitary District shall be June 30, 1971. All
fees due Bella Vista Sanitary District will be
collected and retained by Bella Vista Sanitary
District as in its past operation, until final
dissolution.
4. The Bella Vista Sanitary District shall continue
to maintain its system until June 30, 1971 and
the Contra Costa County Sanitation District
No. 7-A shall have no obligation to maintain
said system until after June 30, 1971.
5. The territory annexed to Contra Costa County
Sanitation District No. 7-A shall pay
to said district for the right to use the exist-
ing property (both real and personal ) of the
district. Said amount to be collected through
a special tax imposed upon the annexed territory
in three (3) equal annual installments beginning
in the 1971-1972 fiscal year.
6. The territory of the Bella Vista Sanitary
District shall be concurrently annexed to County
Sanitation District No. 7-A Improvement District
