Awarding Contract for Chlorine
Storage' Building for Sewage ) (H.&S.C. 4755
Treatment Plant, Work Order 4693.
The Board of Supervisors of Contra Costa County as the Board of
Directors of Contra Costa County'; Sanitation District No. 3'
RESOLVES THAT
Pursuant to this Board's Order of June 30 , 1970 , 'the `Engineer
of Contra Costa County Sanitation District No. 3, Victor W. Sauer,'
has filed with this Board plans and specifications for a Chlorine
Storage' Building at the said Sanitation District No. 3' Sewage
Treatment Plant The said plans and specifications call for
informal bids to be received by the Clerk of the Board until'
11 a.m. on July 7, 1970. This Beard hereby approves the said
plans and specifications.'
Further, this Board'' declares that the public interest and
necessity demand the immediate expenditure of District honey to
safeguard life, health and property on an emergency basis without
soliciting or submitting such expenditure to formal bids, due to
the following circumstances :
1 A 'cease and desist order has been issued, against the
District by the San Francisco Regional Water Quality Control Board
requiring that the District effluent be chlorinated , commending
June 1, 1970. The Regional Board has found that a serious', health
hazard exists.'
2. Appeals to the Regional Board and the State eater Resource's
Control. Board have both' been flatly denied:
3. The basis of the appeals was that the District will be
consolidated with the San Pablo Sanitary District with all pastible-
di;.spatch.
4. The District may be subject to a' fine of up to $6 ,000 per
day until such time as compliance with the cease and desist Order
is effected,
5 It is , therefore, necessary ,that chlorine handling facil-
ities be installed and adequately protected.
The Clerk of this Board reports in connection with said
Chlorine Storage Building that three informal' bids were received
on July 7, 1970 , prior to 11 a.m. , the lowest 'of which was from
Malpass Construction Company' in the amount of $4 ,200. IT IS BY
THIS BOARD ORDERED that the contract for said Chlorine Storage
Building is warded to Malpass Construction Company and that; the
RESOLUTION No. 70140
Chairman of this Board is authorized to execute said contract
after the contractor presents in a form satisfactory to the
District ' s Engineer the surety bonds and insurance certificates
required by the said plans and specifications
Cast _records for the construction of the said Chlorine
Storage Building; shall be ke t by the District 's Engineer ;in the
manner provided in Sections 000 to 4007 of the Government Code.
PASSED ANIS ADOPTED on July 7, 1970 by this Board by at least a
four-fifths vote as follows
