HomeMy WebLinkAboutRESOLUTIONS - 08042003 - 70-337 IN THE BOARD OF SUPERVI30RS OF CONTRA COSTA CO3UNTY, STATE O3F CALIFORNIA In the Matter of Endorsing } Senate Bill Number 11103 and RE30LUTION NUMB 70/337 Assembly Bill Number 1771. 4JHr-12EAS from 1965 through 1969 legislation establishing the San Francisco Bay Conservation and Development Commission has provided for a system whereby each Commissioner could appoint an alternate or proxy; and WHEREAS this system has appeared to be bath workable and fair; and WHEA.S the Legislature in 1969 deleted the sgs:ern' of proxies or alternates from the law; and 1&ffM- EAS two bills in the 1970 Legislature, Senate Bill Number 11103 (McCarthy) and Assembly Bill Number 1771 (Dunlap) , would provide for each member of the Commission to appoint ars alternate , subject to confirmation by each member =s appointing power, thus assuring the public that alternates will be selected carefully and made accountable to the same power that appoints each Commissioner; and WHEREAS Senate Bill Number 11103 requires that each alternate have the same qualifications as the Commissioner who selected him, so that the alternate for a County Supervisor would have to be another Supervisor, while Assembly Bill Number 1771 provides that the choice of alternate need not be so restricted but that every alternate must be approved by the Commissionerts appointing power; and WHEREAS the Legislature has decided that of the 25 members of the Commission eligible to vote on the Bay Conservation and. Development Commission permit applications, 9 shall be County Supervisors and 4 shall be elected city officials ; and WHERE=►AS these locally-elected officials occasionally find that meetings required as part of their local duties conflict with the meetings scheduled by the Bay Conservation and Development Commission, so that they cannot themselves attend but could provide for their localities to be fully represented if alternates could be appointed; NO>W, TH_r,2r4RE, BE IT RESOLVED, that this Board of Supervisors HEREBY SUPPORTS both Senate Bill Number 11103 and Assembly Bill Number 1771; and BE IT ALSO RESOLVED that this Board of Supervisors considers that the flexibility provided by Assembly Bill Number 1771 makes it the preferable of the two bills , but that passage of either bill would be of great benefit; and RESO3LUTION NUMBER 70/337 BE IT ALSO RESOLVED that copies of this resolution be sent to Governor Ronald Reagan, Senator Lewis F. Sherman, Chairman of the Senate Committee on Governmental Organization, Senator John F. McCarthy, Assemblyman John F. Dunlap, all Boards of Supervisors in the other Saar Area Counties, and the County Supervisors Association of California.
