HomeMy WebLinkAboutRESOLUTIONS - 08072001 - 2001-338 f THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on August 7, 2001 , by the following vote: AYES:Supervisors Gioia, Gerber, DeSaulnier, Glover and Uilkema NOES:None ABSENT: None ABSTAIN: None Resolution No.: 2001/338 SUBJECT: A Resolution of the Board of Supervisors of the County of Contra Costa Making Findings Regarding Use of Housing Fund for Acquisition of the Las Juntas Swim Club Property (Assessor's Parcel Numbers 148-180-050, 051 &052), Comprising a 2.1 Acre Site Situated Within the Corporate Limits of the City of Walnut Creek and Adjacent and Contiguous to the County of Contra Costa Pleasant Hill BART Station Redevelopment Project Area. The Contra Costa County Board of Supervisors RESOLVES THAT: WHEREAS, the Board of Supervisors (the "Board") of the County of Contra Costa (the "County") has adopted the Pleasant Hill BART Station Redevelopment Plan by Ordinance No. 84-30 on July 10, 1984, and subsequent amendments thereto (the "Redevelopment Plan"). The Redevelopment Plan sets forth a plan for redevelopment of the Pleasant Hill BART Station Redevelopment Project Area (the "Project Area"). WHEREAS, Health and Safety Code Section 33334.2(g)(2)(A) allows the Board and the Redevelopment Agency of the County of Contra Costa("Agency") to use low and moderate income housing funds maintained pursuant to Health and Safety Code Sections 33334.2 and 33334.3 ("Housing Funds") on projects within the incorporated limits of the City of Walnut Creek, on-site, contiguous to the Project Area if the Board and the Agency determine that the use will benefit the Project Area and the Board and the Agency make the findings required pursuant to Health and Safety Code Section 33334.2(g)(2)(A). WHEREAS, the Board seeks to facilitate the Agency's acquisition of the Las Juntas Swim Club ("the Property") (Assessor's Parcel Numbers 148-180-050, 051 & 052), consisting of a 2.1 acre site situated within the incorporated limits of the City of Walnut Creek and adjacent and contiguous to the Project Area and, to that end, the Board concurrently with adoption of this resolution, is authorizing Agency acquisition of the property from the current owners, Las Juntas Swim Club, David Fischer, Garson Soe and Robert Ormiston, and making the findings required pursuant to Health and Safety Code Section 33334.2(g)(2)(A). WHEREAS, pursuant to Health and Safety Code Section 33334.2(g)(2)(B)(i), the Board desires that the Agency acquire the Property for the development of housing containing units affordable to low- and moderate-income persons, to further the affordable housing and community revitalization goals of the Agency. WHEREAS, development of affordable housing on the Property would provide affordable housing contiguous to the Project Area within walking distance of the BART Station, which will be of benefit to the Project Area. WHEREAS, by staff report accompanying this Resolution and incorporated into this Resolution by this reference (the "Staff Report"), the Board has been provided with additional information upon which the findings and actions set forth in this Resolution are based. 320\01\145958.5 1 NOW, THEREFORE, BE IT RESOLVED, that pursuant to Health and Safety Code Sections 33334.2(g)(1) and (g)(2)(A), the Board hereby finds that acquisition and development of the Property with Housing Funds will be of benefit to the Project Area by providing affordable housing adjacent to the Project Area and the BART Station, thereby reducing traffic congestion in the Project Area by allowing persons to live within walking distance of the BART station or workplaces in the Project Area. These findings are based on the facts and analysis set forth in the Staff Report accompanying this Resolution. BE IT FURTHER RESOLVED, that, pursuant to Health and Safety Code Section 33334.2(g)(2)(A)(i), the Board finds, based on the information in the Staff Report, that both the County of Contra Costa and the City of Walnut Creek have adopted and are implementing complete and current housing elements of their general plans that the Department of Housing and Community Development has determined to be in compliance with the requirements of Article 10.6 (commencing with Section 65580) of Chapter 3 of Division 1 of Title 7 of the Government Code. BE IT FURTHER RESOLVED, that, pursuant to Health and Safety Code Section 33334.2(g)(2)(A)(ii), the Board finds that the acquisition and development of the Property through the use of Housing Funds will not result in any residential displacement from the site where the development is to be built, in that, as set forth in the Staff Report, there are no residents or residential units on the Property. BE IT FURTHER RESOLVED, that, pursuant to Health and Safety Code Section 33334.2(g)(2)(A)(iii), the Board finds,based on the information in the Staff Report, that the area where the Property is located is not one in which more than 50 percent of the population is comprised of racial minorities or low-income families. BE IT FURTHER RESOLVED, that, pursuant to Health and Safety Code Section 33334.2(g)(2)(A)(iv), the Board finds, based on the information in the Staff Report, that development of the property will allow construction of affordable housing at a location closer to a rapid transit station than any other location in the unincorporated territory of the County outside the Project Area, in that the property is closer to the BART station than any other unincorporated area outside the Project Area. BE IT FURTHER RESOLVED, that the Agency shall use the Housing Funds within the incorporated limits of the City of Walnut Creek in compliance with the requirements set forth in Health and Safety Code Section 33334.2(g)(2)(B). 320\01\145958.5 2
