(W05167) The Board of Supervisors of Contra Costa County RESOLVES: 1. On June 26, 2001, the Board of Supervisors adopted Resolution No. 01/287 accepting the petition for the formation of the Discovery Bay West Parking District pursuant to the Parking District Law of 1951 of the Streets and Highways Code,Sections 35100,et.seq.,and the engineer's report for parking district charges for Discovery Bay West. As directed by the Board, the Engineer Ex Officio has filed the engineer's report. 2. On June 26, 2001, the Board adopted Resolution No. 01/287 declaring the Board's intention to levy and collect parking charges to operate and maintain facilities and services within the Discovery Bay West Parking District for Fiscal Year 01-02 and fixing a public hearing for August 14, 2001. Notice of the hearing was given in the time and manner required by law. 3. Resolution No. 01/287 directed the Engineer.Ex Officio to cause to be mailed to property owners within SUB 7686, et.al. the notices and ballots required by Section 4 of Article XIII D of the California Constitution (Proposition 218). 4. The notices and ballots have been mailed to property owners and the returned ballots are ready to be tabulated. NOW, THEREFORE, the Board FINDS, DETERMINES and ORDERS that: 5. A public hearing was held before this Board on August 14, 2001 at 9:00 a.m. At the hearing, the Engineer Ex Officio presented to the Board all ballots received from property owners within SUB7686 and various development phases including SUB 8023. The Board-fieard and considered all protests against the proposed assessments and tabulated the returned ballots according t6 the proportional financial obligation of the affected properties. The Board also afforded to every interested person an opportunity to make a protest to the engineer's report, either in writing or orally, and the Board considered each protest. 6. A majority protest, as defined in section 4(e) of Article X11 D, does not exist. 7. The Board hereby finds that a need exists for parking facilities,confirms the diagram,adopts the final engineer's report,and assessment as set forth in the report of the Engineer Ex Officio and hereby authorizes the levy of the parking charges set forth therein in SUB 7686 and various development phases including SUB 8023, for fiscal . year 2001/02 to be collected on the tax rolls. Assessment on Each Parcel Each parcel in the District shall be assessed: $10.00 in Fiscal Year 2001-2002. Methodology for Calculating Parking Assessments The"benefit received"is based on upon the Equivalent Dwelling Unit(EDU)factor per single family dwelling unit. The parking assessment for this Zone is based upon several factors such as(1)cost required to pay the maintenance costs; (2) the number and types of parcels within this Zone; (3) a reserve fund for administrative and accounting services provided by the County; (4)unforseen expenses such as utility rate increases,and maintenance(including replacement) of the parking improvements. The assessment revenue is used to pay for the total costs of operating the Parking District and those costs are apportioned among the various parcels in the Discovery Bay West Parking District.
