THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY , CALIFORNIA
Adopted this Order on December 4, 1984 , by the following vote:
AYES: Supervisors Powers , Fanden, Schroder, McPeak and Torlakson
NOES: None
ABSENT: None
ABSTAIN: None
SUBJECT: Proposed Area of Benefit , Bates Avenue/North Concord area.
This being the time for hearing on the proposed establish-
ment of an Area of Benefit for Bates Avenue/North Concord area;
Michael Walford , Public Works Director, explained the pro-
posal and the benefits expected to be derived therefrom for the
area. Mr . Walford advised that the property owners are also con-
sidering the possibility of an assessment district in the same area
and discussed generally the manner of determining the fee for each
parcel .
Mr . Walford recommended that the Board approve formation
of the Area of Benefit and the proposed fees , that the boundary be
changed to exclude any area within the City of Concord , and that the
Board state its intent to waive the fee for any parcel which will
participate in any assessment district for the area.
The Chair declared the hearing open and the following per-
sons appeared and commented:
Scott Gordon , attorney for Tosco Corporation , who
requested that the matter be continued for 60 days .
Winton Jones , 1949 Arnold Industrial Way, Concord, who
cited alleged errors in the Environmental Impact Report .
Maurice Huget , Jr . , attorney for Concord Industrial Park ,
who filed a letter, of protest .

Robert Rossi of Seeno Construction Company, who filed a
letter of protest .
Don H . Gorman, 1667 St . Lawrence Way, Pleasant Hill , who
filed a letter objecting to being included in the Area of Benefit
and asking for exclusion.
Fred Lowe, who inquired about the boundaries of the Area
of Benefit as well as the assessment district .
Supervisor McPeak recommended that the matter be continued
for 60 days and requested the Public Works Director to continue
discussions with property owners on both the proposed Area of
Benefit and an assessment district . She also requested County
Counsel to review any alleged errors in the Environment Impact
Report .

IT IS BY THE BOARD ORDERED that this hearing is CONTINUED
to February 5, 1985 at 10: 30 a.m. , and the Public Works Director is
REQUESTED to continue discussions with land owners on both the pro-
posed Area of Benefit and an assessment district .
IT IS FURTHER ORDERED that County Counsel is REQUESTED to
review the Environment Impact Report and report to the Board within
two to four weeks .
