Adopted this Resolution on August 6, 1996 by the following vote:

SUBJECT: Completion of Subdivision Improvements, Completion of Acquisition of Off-site
Rights of Way Agreements, and Declaring Certain Roads as County Roads,
Subdivision 7597, Bay Point Area.
The Public Works Director has notified this Board that the Subdivision Improvements in
Subdivision 7597 have been completed as provided in the Subdivision Agreement with Kaufman&
Broad ofNorthern California, Inc. heretofore approved by this Board in conjunction with the filing
of the Subdivision Map.
NOW TfIEREFORE BE IT RESOLVED that the improvements have been COMPLETED
as of July 20, 1995 thereby establishing the six-month terminal period for the filing of liens in case
of action under said Subdivision Agreement:

BE IT FURTHER RESOLVED that Driftwood Drive, Powell Court, Powell Drive, Steffa
Street, Caskey Street, Kelsey Court and Dodd Court thereinafter described roads, as shown and
dedicated for public use on the final map of Subdivision 7597 filed August, 19, 1993, in Book 368
of maps at page 6, Official Records of Contra Costa County, State of California, are ACCEPTED
and DECLARED to be County Roads.
SUBJECT: Completion of improvements, and declaring certain roads as county roads, subdivision
7597, bay point area.

BE IT FURTHER RESOLVED that the widening of Evora Road is ACCEPTED and
DECLARED to be a County road;the right of way was conveyed by separate instrument, recorded
on August 19, 1993, in Volume 368 of Official Records on page 6.
BE IT FLIRT BER RESOLVED that the beginning of the one year warranty period is hereby
established, and the$40,000 cash deposit(Auditor's Deposit Permit No.224990, dated May 4, 1993)
made by Kaufman&Broad of Northern California,Inc. be RETAINED for one year pursuant to the
requirements of Section 944.406 of the Ordinance Code.
The Public Works Director has also notified this Board that two of the three acquisitions of
Off-site Rights of Ways for Subdivision 7597 have been accquired as provided in the Acquisitions of
Off-site Rights of Way Agreements with Kaufman&Broad of Northern California, Inc. heretofore
approved by this Board in conjunction with filing of the Subdivision Map.
The off-site right of way for the widening of Evora Road has been acquired from
Calvary Temple.
NOW THEREFORE BE IT RESOLVED that the agreement with Kaufman &Broad for
acquisition of off-site right of way from Calvary Temple and the $29,000 Bond issued by the
American Insurance Company (Bond No. 11133069333) is exonerated, and the Public Works
Director is AUTHORIZED to refund the $3,500 cash security (Auditor's Deposit Permit No.
228532, dated July 12, 1993) plus interest in accordance with Government Code Section 53079, if
appropriate, to Kaufman & Broad of Northern California pursuant to the requirements of the
Ordinance Code.
The off-site storm drain easement has been acquired from East Bay Municipal Utilities
District(EBMUD) and Contra Costa Water District (CCWD).

NOW THEREFORE BE IT FURTHER RESOLVED that the agreement with Kaufinan&
Broad for acquisition of the off-site storm drain easement from EBMUD and CCWD and the $28,000
Bond issued by the American Insurance Company(Bond No. 11133069341)is exonerated and the
Public Works Director is AUTHORIZED to refund the$2,000 cash in accordance with Government
Code Section 53079, if appropriate, to Kaufinan & Broad of Northern California pursuant to the
requirements of the Ordinance Code.
The security for Acquisition of Off-site Right of Way whereby said subdivider agrees to pay
all costs and expenses involved in acquiring off-site right of way from Atchison Topeka and Santa
Fe Railroad Company, Southern Pacific Railroad Company,,Sacramento Northern Railroad Company,
and USA(Navy)for the off-site storm drain outfall will not be exonerated and will remain in affect.
