HomeMy WebLinkAboutRESOLUTIONS - 08061996 - 96-346 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on August 6, 1996 by the following vote: AYES: Supervisors Rogers, Bishop, DeSaulnier, Torlakson, Smith NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 96/346 SUBJECT: Approval of a Substitute Road Improvement Agreement, Road Acceptance #1021 Cross Reference City of Pleasant Hill Subdivision 7243, Reliez Valley Area The following document was presented for Board approval this date: A substitute Road Improvement Agreement with Davidon Homes, developer, whereby said developer agrees to complete all improvements as required in said Road Improvement within one year from the date of said agreement; Said document was accompanied by the following: Security to guarantee the road improvements as required by Title 9 of the County Ordinance Code, as follows: a. Cash deposit (Auditor's Deposit Permit No. 281179, dated July 18, 1996) in the amount of$2,250, made by Davidon Homes. b. Additional security in the form of a corporate surety bond dated February 20, 1996, and issued by The American Insurance Company (Bond No. 11127305081)with Davidon Homes, as principal, in the amount of $222,750 for faithful performance and $112,500 for labor and materials. All deposit permits are on file with the Public Works Department. NOW THEREFORE BE IT RESOLVED that said substitute Road Improvement Agreement is APPROVED. BE IT FURTHER RESOLVED that the Road Improvement Agreement with BA Properties, Incorporated, as approved by the Board on September 8, 1992, is TERMINATED, the improvement security bond with United Pacific Insurance Company is EXONERATED and the Public Works Director is AUTHORIZED to refund both: the cash deposit (Auditor's Deposit Permit No. 213112, dated September 9, 1992) in the amount of $710, plus interest in accordance with Government Code Section 53079, if appropriate, to BA Properties, Inc., and the cash deposit (Auditor's Deposit Permit No. 209993, dated July 1, 1992) in the amount of$1,540, plus interest in accordance with Government Code Section 53079, if appropriate, to BA Properties, Incorporated.
