HomeMy WebLinkAboutMINUTES - 12041984 - T.11 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on December 4, 1984 , by the following vote: AYES: Supervisors Schroder , McPeak NOES: Supervisors Powers , Fanden , Torlakson ABSENT: None ABSTAIN: None SUBJECT: Decision on appeal of Schell & Martin Inc . , from the San Ramon Valley Area Planning Commission decision on Condition No . 4 of MS 25-84 in the Alamo area . The Board on November 6 , 1984, deferred decision to this date,, on the appeal of Schell & Martin Inc . , from the San Ramon Valley Area Planning Commission decision on Condition No . 4 of MS 25-84 in the Alamo area; and Supervisor Torlakson advised that the decision on this matter was tabled on the recommendation of County Counsel because of a tie vote by Board members; and Boyd Jewett , County Public Works Department , advised that there has been a disagreement between the applicant and the County Public Works staff as to whether the drainage culvert in this area is adequate for proper drainage; and Supervisor Schroder commented that he had previously recommended that the appeal be granted based on specific findings persuant to the formation of an Assessment District , and that the applicants be required to participate in an Assessment District at the "time of its formation in this area, and advised that this would be his motion on the appeal of Schell- & Martin Inc; and Supervisor McPeak seconded the motion made by Supervisor Schroder; and Supervisor Powers advised that , in his opinion, this sub- division did not meet the criteria set out for Flood Control purposes and commented that he felt this subdivision should comply with the Flood Control Ordinances , and also stated that he could not support the motion made by Supervisor Schroder; and Supervisor Fanden concurred with the comments made by Supervisor Powers , and stated that she felt that if this subdivision were allowed it would subject the County to undue liability; and Supervisor Torlakson also advised that he would be unable to support the recommendation made by Supervisor Schroder , and com- mented that he felt this decision would be precedent setting if the appeal were approved . E. Manderscheid, Regional Planning Officer, United States Department of the Interior, Bureau of Reclamation, Mid-Pacific Regional Office, 2800 Cottage Way, Sacramento, California 95825, transmitting a copy of Information Bulletin 4, the .fourth in a series of bulletins on the San Luis Unit Special Study on environmental problems related to agricultural. drainage on the west side of the San Joaquin Valley, and actions proposed to solve them, noting that Bulletin 4 presents the measures being considered and interim actions under way to keep waterfowl and other wildlife from using Kesterson Reservoir until a long-term solution to the selenium problem can be developed; IT IS BY THE BOARD ORDERED that the aforesaid matter is REFERRED to the Water Committee. hereby certify that this Ir a fret tnd eorroct copy of an action taken and enterod m tim minutes of the Board of Supervisors on the date shown.
