HomeMy WebLinkAboutRESOLUTIONS - 08131996 - 96-368 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on August 13, 1996 by the following vote: 2, AYES: Supervisors Rogers, Bishop, DeSaulnier, Torlakson, Smith NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO.: 96/368 SUBJECT: Completion of Improvements, Declaring Vintage Parkway as a County Road, and Completion of Warranty Period for Road Acceptance 1014 Phase I (railroad over crossing to SR4), Exoneration of Phase II Road Improvement Agreement (for Vintage Parkway) and Release Bond, and Exoneration of Right of Way Acquisition Agreement and Release Bond Rider, Subdivision 6862, Oakley area. The Public Works Director has notified this Board that the improvements for Vintage Parkway from the railroad over crossing to Highway 4 have been completed as provided in the Substitute Road Improvement Agreement with The Hofmann Company heretofore approved by this Board on February 27, 1990. The substitute road improvement agreement was to separate improvements to Vintage Parkway south of the railroad over crossing that had not been completed by February 27, 1990, from improvements north of the railroad over crossing that had been completed. The Public Works Director has further notified this Board that the conditions of approval for Vintage Parkway, Phase II Road Improvement Agreement, (previously approved on January 5, 1988) have been satisfied. This Road Improvement Agreement was for improvements to the intersection of Vintage Parkway and Highway 4. The Hofmann Company has paid its share ($387,000) for the design and construction of a traffic signal and associated road widening at the intersection of Vintage Parkway and Highway 4. These improvements will be incorporated into a larger County project for Highway 4. The Public Works Director having also reported that the Right of Way Acquisition Agreement, first approved by this Board on September 1, 1987, and later amended on January 19,1988, is no longer necessary for the condemnation of land to construct the Phase I improvements for Vintage Parkway. The right of way has been acquired and the improvements completed. NOW THEREFORE BE IT RESOLVED that the road improvements have been COMPLETED as of July 30, 1996. BE IT FURTHER RESOLVED that the herinafter described road, as dedicated for public use on the final order in condemnation filed August 27, 1993, in Book 18886 at page 143, Official Records of Contra Costa County, State of California, is ACCEPTED and DECLARED to be a County Road. BE IT FURTHER RESOLVED that there is no warranty period because the majority of the improvements were completed more than a year ago, and Public Works Director is AUTHORIZED to refund the $1,000 cash security for performance (Auditor's Deposit Permit No. 168775, dated February 9, 1990)plus interest in accordance with Government Code Section 53079, if appropriate, to The Hofmann Company pursuant to the requirements of the Ordinance Code. (Bond No. 11132738920) BE IT FURTHER RESOLVED that the Phase II Road Improvement Agreement for Vintage Parkway is hereby EXONERATED, and the Public Works Director is AUTHORIZED to refund the$1,964 cash deposit (Auditor's Deposit Permit No. 133708, dated December 18, 1987) plus interest in accordance with Government Code Section 53079, if appropriate, to The Hofmann Company, pursuant to the requirements of the Ordinance Code.
