HomeMy WebLinkAboutRESOLUTIONS - 08081995 - 95-364 r THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on August 8, 1995 by the following vote: AYES: Supervisors Rogers, Smith, DeSaulnier, Torlakson, Bishop NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 95/364 SUBJECT: Approval of the Final Map and Subdivision Agreement, Subdivision Right of Way Landscaping Agreement and an Acquisition of Off-Site Right of Way Agreement for Subdivision 7640, Oakley Area. The following documents were presented for Board approval this date: The Final Map of Subdivision 7640, property located in the Oakley area, said map having been certified by the proper officials. A Subdivision Agreement with HPH Homebuilders 1995 L. P., subdivider, whereby said subdivider agrees to complete all improvements as required in said Subdivision Agreement within one year from the date of said agreement. Said documents were accompanied by: I. Security to guarantee the completion of road and drainage improvements as required by Title 9 of the County Ordinance Code, as follows: A. Cash deposit (Auditor's Deposit Permit No. 264296, dated July 20, 1995) in the amount of$8,100 made by HPH Homebuilders 1995 L.P.. B. Additional security in the form of a corporate surety bond dated July 12, 1995, and issued by Insurance Company of the West (Bond No. 1221199) with HPH Homebuilders 1995 L.P. as principal, in the amount of$802,700 for faithful performance and $405,400 for labor and materials. A Subdivision Right of Way Landscaping Agreement with HPH Homebuilders 1995 L. P., subdivider, whereby said subdivider agrees to complete all improvements as required in said Subdivision Right of Way Landscaping Agreement within one year from the date of said agreement. Said documents were accompanied by: I. Security to guarantee the completion of landscaping improvements as required by Title 9 of the County Ordinance Code, as follows: A. Cash deposit (Auditor's Deposit Permit No. 264503, dated July 25, 1995 in the amount of$1,000 made by HPH Homebuilders 1995 L.P. B. Additional security in the form of a corporate surety bond dated July 26, 1995, and issued by Insurance Company of the West (Bond No. 1375352) with HPH Homebuilders 1995 L.P. as principal, in the amount of$24,465 for faithful performance and $12,733 for labor and materials. II. Letter from the County Tax Collector stating that there are no unpaid County taxes heretofore levied on the property included in said map and that the 1994-95 tax lien has been paid in full and the 1995-96 tax lien, which became a lien on the first day of March, 1995, is estimated to be $12,300. III. Security to guarantee the payment of taxes as required by Title 9 of the County Ordinance Code in the form of a surety bond, No. 1375351, issued by Insurance Company of the West with HPH Homebuilders 1995 L.P. as principal, in the amount of $12,300 guaranteeing the payment of the estimated tax; The Public Works Director having further reported that the permanent drainage improvements required by the Ordinance Code for Subdivision 7640 involve construction of a storm drain line through four different properties. The developer has been working for several months on obtaining the easements and has been successful with all but one property owner. To assure the acquisition of the remaining easement, across the Louis J. Del Barba parcel, the developer has executed an Acquisition of Off-Site Right of Way Agreement. The following document was presented for the Board for approval this date: 1. An agreement for acquisition of off-site right of way for Subdivision 7640, with HPH Homebuilders 1995 L.P., subdivider, whereby said subdivider agrees to pay all costs and expenses involved in acquiring off site right of way from Louis J. Del Barba for an off-site drainage easement. Said document was accompanied by security to guarantee payment of off-site right of way acquisition expenses as follows: a. Cash deposit (Auditor's Deposit Permit No. 264428, dated July 24, 1995) in the amount of$32,650. NOW THEREFORE BE IT RESOLVED that said subdivision, together with the provisions for its design and improvement, is DETERMINED to be consistent with the County's general and specific plans; BE IT FURTHER RESOLVED that said Acquisition of Off-Site Right of Way Agreement for Subdivision 7640 is also approved and the Chair is authorized to execute said agreement. NOW THEREFORE BE IT RESOLVED that said subdivision, together with the provisions for its design and improvement, is DETER LINED to be consistent with the County's general and specific plans. BE IT FURTHER RESOLVED that said Final Map is APPROVED and this Board does not accept or reject on behalf of the public any of the streets, paths, or easements shown thereon as dedicated to public use. BE IT FURTHER RESOLVED that said Subdivision Agreement is also APPROVED. BE IT FURTHER RESOLVED that said Right of Way Landscaping Agreement is also APPROVED.
