SUBJECT: Establish Fee for Processing RESOLUTION,NO. 91/712.
Court Fine Accounts Receivable
WHEREAS, Penal Code Section 1205(d) states that"the board of supervisors in any county may
establish a fee for processing of accounts receivable that are not to be paid in installments. The fee shall
be equal to the administrative and clerical costs except that the fee shall not exceed thirty dollars." And
WHEREAS, the municipal courts were required to discover means to operate within a reduced
budget; and
WHEREAS, additional court and clerical time involved in the establishment and processing of a
fine receivable have been determined to average fifteen dollars per case; and
WHEREAS,when a fine is ordered payable to the Office of Revenue Collection (ORC),defendants
receive billing statements and are permitted to make installment payments, the estimated administrative
and clerical costs for which exceed thirty dollars ($30);
NOW, THEREFORE, BE IT BY THE BOARD RESOLVED, that the following fees are established
pursuant to authority contained in Penal Code Section 1205(d) for the administrative and clerical costs
incurred for processing court imposed fine receivables as follows:
a. A fifteen dollar($15) fee to be imposed by the Municipal Courts in those cases in which
a defendant is given time to pay a court—ordered fine directly to the Courts.
b. A thirty dollar ($30) fee to be imposed by the Office of Revenue Collection (ORC) in those
cases in which a defendant has been placed on formal or summary court probation and
has been ordered to pay installments directly to ORC.
