HomeMy WebLinkAboutRESOLUTIONS - 09121989 - 89-602 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on September 12 , 1989 by the following vote: AYES: Supervisors Powers , Fanden, Schroder, McPeak $ Torlakson NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 89/602 SUBJECT: Approval of the Parcel Map and Subdivision Agreement for Improvement Warranty for Subdivision MS 36-86, Walnut Creek Area. The Public Works Director having notified this Board that the improvements for Subdivision MS 36-86 have been completed and that such improvements were constructed without the need for a Subdivision Agreement. The following documents were presented for Board approval this date: The Parcel Map of Subdivision MS 36-86, property located in the Walnut Creek area, said map having been certified by the proper officials. A Subdivision Agreement for Improvement Warranty with Harold H. Foster, subdivider, whereby said subdivider agrees to satisfy any valid claims or liens of labor and materials as to the said improvements and subdivision appearing hereafter upon demand by the County as required in said Subdivision Agreement for Improvement Warranty within six months from the date of said agreement. Said documents were accompanied by: I. Security for labor and materials for the six-month lien guarantee period as ' required by Title 9 of the County -Ordinance Code, as follows: A. Cash deposit (Auditor's Deposit Permit No. 159528, dated July 17, 1989) in the amount of $5,800 made by Harold H. Foster. II. Letter from the County Tax Collector stating that there are no unpaid County taxes heretofore levied on the property included in said map and that the 1988-89 tax lien has been paid in full and the 1989-90 tax lien, which became a lien on the first day of March, 1989, is estimated to be $3 , 800. III. Security to guarantee the payment of taxes as required by Title 9 of the County Ordinance Code in the form of a cash deposit (Auditor' s Deposit Permit No. 159744, dated July 21., 1989) made by Fidelity National Title in the amount of $3,800 guaranteeing the payment of the estimated tax; NOW THEREFORE BE IT RESOLVED that said subdivision, together with the provisions for its design and improvement, is DETERMINED to be consistent with the County's general and specific plans. RESOLUTION NO. 89/602 i7 V U. BE IT FURTHER RESOLVED that said Parcel Map is APPROVED. BE IT FURTHER RESOLVED that the improvements have been COMPLETED as of June 6, 1989 thereby establishing the six-month terminal period for the filing of liens in case of action under said Subdivision Agreement for Improvement Warranty; BE IT FURTHER RESOLVED that said Subdivision Agreement for Improvement Warranty is. also APPROVED. BE IT FURTHER RESOLVED that the $5,800 cash security for labor and materials (Auditor's Deposit Permit No. 159528, dated July 17, 1989) deposited by Harold H. Foster be RETAINED for the six-month lien guarantee period until December 6, 1989, at which time the Public Works Director is AUTHORIZED to refund the cash security less the amount of any claims on file. 0 I hereby certify that this is a true and correct copy of an action taken and entered on the minutes of the Board of Supervisors-on the date shown.
