HomeMy WebLinkAboutRESOLUTIONS - 08081989 - 89-541 1-054 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on August 8, 1989 by the following vote: AYES: Supervisors Powers, Fanden, Schroder, McPeak, Toriakson NOES: None ABSENT: None ABSTAIN: None ------------ ------------------------ --------------- -------------------------- ------------ ----------------------------------------------------------- SUBJECT: Determination of Property Tax ) Exchange for Bettencourt/Ujdur ) Annexation to County Service ) RESOLUTION NO. 89/ 5141 Area P-2A (LAFC 89-27) ) WHEREAS, Section 99.1 of the Revenue and Taxation Code provides that a jurisdictional change resulting from a special district providing one or more services to an area where such services have not previously been provided shall not become effective if one or more affected special districts involved in the property tax exchange negotiation fails to adopt a resolution agreeing to a transfer; and WHEREAS, with the exception of the annexing district, the Board of Supervisors shall determine the property tax exchange for each affected district that fails to adopt a resolution agreeing to a property tax transfer; and WHEREAS, County Service Area P-2A (CSA P-2A) is the only affected agency in the Bettencourt/Ujdur Annexation to CSA P-2A and the Board of Supervisors hereby agrees that no property tax will be exchanged as a result of this annexation. NOW, THEREFORE, BE IT THAT THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY HEREBY DETERMINES that no property tax will be transferred to CSA P-2A as a result of annexing the territory described in Bettencourt/Ujdur Annexation to County Service Area P-2A. This resolution does not change the property tax revenue accruing to other agencies serving the subject territory or the affected districts' right to collect taxes for existing bonded indebtedness. The property tax exchange agreement discussed above shall apply to affected territory as submittdd or revised by the Local Agency Formation Commission. ATTESTED: AUG 8 1989 Phil Batchelor, Clerk of the Board of Supervisors and County Administrator By t� Deputy cc: Auditor-Controller County Administrator County Counsel LAFCO Sheriff-Coroner RESOLUTION 89/ 541 W 1-054 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on - ugust 8, 1989 by the following vote: AYES: Supervisors Powers, Fanden, Schroder, McPeak, Torlakson NOES: None ABSENT: None ABSTAIN: None SUBJECT: Determination of Property Tag ) Exchange for Duperu Drive ) Annexation to County Service ) RESOLUTION N0. 89/ 540 Area P-1 (LAFC 89-22) ) WHEREAS, Section 99.1 of the Revenue and Taxation Code provides that a jurisdictional change resulting from a special district providing one or more services to an area where such services have not previously been provided shall not become effective if one or more affected special districts involved in the property tax exchange negotiation fails to adopt a resolution agreeing to a transfer; and WH MEAS, with the exception of the annexing district, the Board of Supervisors shall determine the property tax exchange for each affected district that fails to adopt a resolution agreeing to a property tax tranfer; and WHEREAS, County Service Area P-1 (CSA P-1) is the only affected agency in the Duperu Drive Annexation to CSA P-1 and the Board of Supervisors hereby agrees that no property tax will be exchanged as a result of this annexation; and WHEREAS, the original application for the subject annexation has terminated because a property tax exchange resolution was not adopted within the period specified by law. NOW, THEREFORE, BE IT THAT THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY HEREBY RESOLVES that no property tax will be transferred to CSA P-1 as a result of annexing the territory described in Duperu Drive Annexation to County Service Area P-1. This resolution does not change the property tax revenue accruing to other agencies serving the subject territory or the affected districts' right to collect taxes for existing bonded indebtedness. The property tax exchange agreement discussed above shall apply to affected territory as submitted or revised by the Local Agency Formation Commission. The Board hereby renews and incorporates by reference, its proposal for annexation contained in Resolution No. 89/287 to reinitiate its original application.
